    • You did what??? You asked them to send you the documents that without them you had  a 100% ironclad win in Court. Why on earth would you do that? As it happens in this case, there is still enough mistakes in their PCNs and the NTH to have your case cancelled. Amd it may be that not sending those documents in the first place along with the ICO complaint and the letters from Alliance themselves which would confirm by the dates on the letters may be enough to cancel it anyway. I hope you have kept their letters as evidence? The chances are that Alliance will not actually take you to Court because of their errors but you never know.  You have made so much extra work for yourself in your WS if they decide to push their luck.though. Can you please post up their letter where they give the reason why I wasn't sent with the NTH.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

A friend of mine had his gas meter read recently and the guy stated it looked as if it has been tampered with. They took the meter away for checking and said it had been confirmed that it had. My friend knows nothing about this and always just paid his bill as normal when they came through. He wouldnt even know what to do with a gas meter never mind tamper with it. The supplier has now issued him with a bill for £5000 and stated unless he paid for the gas used the case will be forwarded to CPS for prosecution. He lives alone and his usage has never been high. Any advice please?????

How long has your friend lived here? Have his bills always seemed unreasonably low? It's possible a former occupier may have done the tampeing & in my experience, meter tamperers don't usually let the meter man in, so it may not have been discovered until now.

The meter operators are very experienced in this sort of thing & usually the signs of tampering are quite obvious, so I would think it unlikely that they had made a mistake. It's possible the tamper may have been removed before your friend moved in, but the telltale signs are left behind. If your friends consumption is around average for the type of equipment in use, that would indicate that may have been the case.

Thank you - my friend moved in, in March 2005 and he lives alone so his bills have been average for a single occupancy. He had no problem allowing the gas man in to check the meter as he was none the wiser about this sort of thing and would of reported it in the first place had he of known. I guess the gas supplier should be looking into the previous owners and checking them too.

Does meter tampering actually go on? I thought is was an urban legend.

In some of the various houses I've lived in, I've had allsorts of bother with the gas. My current house which is currently undergoing long term renovation doesn't have anything that runs on gas. Because no gas was being used they suspected meter tampering, but eventually decided that the meter was faulty and replaced it with one set forward by an estimated amount! I wish I'd disputed this amount, but I just paid it and changed company. After much hassle involving endless estimated bills and changing companies a couple of time, I now don't get bills, and the meter has been removed but it's been a long struggle.

If the bills were all ok and not suspiciously low I don't see how they can make accusations and your friend should formally dispute the bill before it gets any worse.

Does anyone else find it strange that they're claiming that the law has been broken and threatening action by the CPS if a huge amount is not paid. If the law has been broken, surely it should be investigated properly, otherwise it's like saying to a landowner where a body has been found that if he doesn't pay a large but arbitrary sum of money, there will be an investigation.... or like saying to cheating MP's that they have broken the law but if they pay back some of the cash, they won't be prosecuted....

I can assure you meursault that meter tampering is most defnitely NOT an urban legend. It is widespread. The reason you don't hear more about it is that suppliers are very reluctant to prosecute. The reasons are not clear to me, as I believe it would deter others, but for some reason, they seem to believe it is "bad publicity" & also detailed court cases might give ideas to others.
