    • We need to see the actual document from the IAS where it is written - "The Operator's evidence shows no payment for the Appellant's vehicle, or anything similar. It does show two payments for the same registration in quick succession. I would take a reasonable guess, based on the circumstances described, that the person paying has paid for the registration of the person they assisted again." You can't just type it up yourself. At the hearing in July or August or whenever the judge will have two Witness Statements. One from Bank's director says you never made a second appeal. You say you did make a second appeal and the IAS concluded that payment was made. The judge will immediately twig that either you or the director is lying.  But who? Fail to show the documentation form the IAS and instead just produce something you've typed yourself will make it look like you just made up the appeal and you are lying and you will lose the case. Please let us see what the IAS adjudicator sent.
    • I used to have a retail outlet in London selling my husband's photography.  We also had a co-op with staff so they weren't directly employed by me, but I paid for the other overheads etc.  When my husband died, I carried on as usual for a while but then I became ill and moved quite far away so logistically was becoming very difficult.  I came to an arrangement (verbal) with one of the guys I trusted, that I would send him the images to print and sell as normal, and I wouldn't take any money, as a short term solution until I got back on my feet and worked out the best way to do things. He would pay all the  rent, insurance etc... Over a year later, not able to give things away for free anymore,  I drew up a contract as a wholesale agreement, so I would get everything printed and sent to him and I would invoice his for what he ordered. I noticed form the beginning that he wasn't ordering enough or frequently enough to be making any money, and was suspicious he was doing his own orders on the sly and ordering just enough from me to keep my happy.  I checked with my printer, which I've been with for 20 years, and he sad he wasn't getting orders for my images from anyone else. I emailed a few other printers to ask them to keep a look out for some images but I soon realised this would be impossible to police.  The only option really would be to buy a print from him and check the stamp on the back of it.  I finally managed to get hold of on the prints on sale, and sure enough, he did not order it through me.   In the contract he signed in 2022 it explicitly states that he must destroy all files I had previously sent him etc etc so e is in breach of that.  When I drew up the contract, I was careful to make sure it was legally binding, but before I let rip at him, I need to know where I stand.  The contract is here: PARTIES This WHOLESALE AGREEMENT (“Agreement”) is made effective as of 30th June, 2022, by and between ############################## The Supplier and the Client, collectively referred to as the "Parties," hereby agree to the following terms: TERMS AND CONDITIONS SALES OF GOODS The Supplier agrees to provide the following goods to the Client (“Goods”): Description of Goods ################################# Doc ID: 3d54c1d336d8780243801e0e068ebd33114b088b BOTH PARTIES AGREE: The Client purchases the Goods through the Supplier directly, and agrees to delete/destroy any previously held digital images (Goods) owned by the Supplier, and agrees not to use any such files for monetary gain, outside of this agreement, either directly or through a third party from immediate effect of this agreement. The Client purchases the other materials necessary for resale of the Goods independently of this agreement. I'm thinking I might tell him I will continue with the contract but ask for a  sum in damages and say that if I find out he's still doing it down the line I will terminate the contract and sue him for damages. The damages side of things I'm not sure how it would work as he is self employed, and I'm positive he doesn't declare all of his earnings to HMRC, in order to find out how much I have lost, would the court demand to go through his tax self assessments?  I'm not sure how to proceed with this, I don't want to lose that place as an outlet as it is in a prime spot in London, which is why I let him have those images in the first place as I would have had to pull out altogether at that point.  I am regretting it somewhat now though.  Please help.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

don't mean to be rude or nuthing,because i think what everyone is doing to solve this is amazing,but do you think we are gettin anywere? am really worried they gunna expect this 11k soon man. i have every letter barclays have sent me and also the 2nd copy of the form i signed.plus the stupid folder i got of advent,i aint the brightest when it comes to stuff like this am really worried.

its funny because,they sent me that introduction folder or what ever that piece of ****e was,and i had no interest in reading it,because i had already made the mistake signin with them,and they never ever once fought of contactin me to see what the delay was? now even if i refused to do the course i am signed to them,so they should still really be sendin work to me,never recieved nuthin but one folder in feb 09! am gunna fight this to the end with u guys

I know exactly how you feel and it's very worrying Martin has made a seperate thread for people like you and me who are either yet to start paying or like me have just started. Except I'm not paying for receiving nothing.

Drop a post in there as it'll help to see how many need a certain letter involving these circumstances. And anyone else reading please do this too.

 

My lump sum was due beginning March but they added the interest anyway.

even though it was on hold. Don't worry click the red triangle and join in and fight back.

thank you Bluedo ,10 pack..i told them that i aint payin for the course because its a conn,i sent barclays a written letter on feb askin to be canceld with immediate effect,and they told me i missed the right to cancel by 2 days,now they could have had the letter 2 days before..but waited to reply..i dont know,so i was really ****ed,they bassically said i have a year..then i got the letter sayin advent went under,no wounder..but then they found a new ****whole to fill the whole?.

Basically I thought it would be a good idea to offer the help to those who are not being represented by solicitors-I think its reasonable to assume that this group will be taking guidance from them.

Hi I don't mean to put a spanner in the works and will delete this post if it is out of context, but please you guys have a read of my case and see if it has any relation to what you guys are going through, as admin and other site members just keep referring me to this thread. here goes...

 

In April 2007, I was a 19yr old young man preyed upon by a Computeach pressure salesman. He promised me only 8 hours a week of study would be fine to complete the course in two years. I have this on my copy of the contract signed by Computeach and myself.

 

I also explained to the salesman my personal situation with my son whom at the time was seriously/terminally ill. He assured me that it wouldn't be a problem etc and again like most other people on these forums was promised a world of 'personal' tutoring, support, individually tailored tutoring etc etc. I have all my records in order.

 

The financial side of it was funded through a Barclays Career Devlopment Loan for 80% of the course fees. The other 20% of the course fees were funded via a company called Marehill Finance, who I understand to be Computeach's 'in house' finance department.

 

Barclays Loan - £3800.00

Marehill Finance - £750.00

Deposit - £200

 

Course Total - £4750

 

I managed to complete my first part of the course which was the IC3 module, so around 25% of the total course length.

 

I kept in touch with computeach via email about my personal situation and did ask on several occassions for a refund and to cancel the course they said it wouldn't be possible even in my situation and all they would do is give me a 12month extention on the course.

 

I am claiming for a partial refund and have informed barlcays by way of letter that I am looking for a refund from computeach so that I can pay off the loan I have with them. As regards to the Marehill finance part of the finance, I have been paying that since June 2007 and it is fully paid off in June 2010.

 

I am looking for advice on how to go about claiming my course fees back, including examination fees that I havent even sat. Also how to tidy up the finance and get these loans cleared, hopefully in the way of a refund via Computeach.

 

Sorry for the lengthy post but I am thorough ;)

I am also getting to the point where I don't know wether to just cancel my standing order with barclays, move my bank account (I bank with Barclays) and let them chase me for the money/take me to court and have it all out there?

Yes it was me who contacted you and referred you here after I stumbled on your post which was in the general forum.

I did move your post here.

I was interested to read of your finance deal with Marehill and it prompted me to look into their dealings.

Up to you posting I was not aware of Marehill except to see they were showing as registered at the same postcode as Computeach on the ICO public register.

 

I also thought it was interesting to see that Barclays had been in co-operation with Computeach with finance previously - which I dont think anyone was aware of.

Presumably this was before Advent were partnered with BPF.

Having looked at their Consumer Credit Licence,I saw that Marehill Finances Consumer Credit Licence expired in June 2009 and there appears to be no conclusive sight of it being renewed.

I have contacted both the OFT and Dudley trading standards to get clarification.

Can you please indicate Marehills address and postcode from your last communications from them ?

And also any company reg details from their letters.

Hi Martin, yes it has all come together for me now and I think I have landed in the right place.

 

I have ALL copies of any agreements made between myself, Marehill Finance, and also BPF.

 

Quick question, now they have no longer got a licence could I cancel my direct debit to them and not worry about debt collectors?

 

Secondly, here is Marehill Finance's last address I have on my credit agreement with them;

Yes you may recognise this address, as it is EXACTLY the same building that CT trade from and where there in-house training happens, if it happens at all.

signed up with them 30 April 2009, decided didnt want to continue so tried to cancel with advent, but no-one got back to me. I haven't paid anything yet, but due to start paying on 30/04/2010. As far as im aware any DD has not been cancelled. I was going to pay everything in one go, but definately dont want to be paying anything now. getting worried as im unemployed and cant really afford to pay out £5000, and i have already decided on another career path to persue. please advise as best you can :)

I haven't had a chance to read 2100+ threads, but if it was me in some people's situation then I would not be paying a penny, it seems blatantly obvious that the contract/agreement will not be fulfilled....this just sounds a little similar to the Park Hampers situation from a few years ago. If there are those that have paid and it is unlikely that they are going to be getting anything else from this company then it would seem to be an unlawful recission of contract on their part.....I would write/use Consumer Direct / Trading Standards / Local MP / OFT and the FOS. Were they part of any governing association or trade body ? Also it might be worth contacting the official receiver too. If there is a lawyer representing one or a few then hopefully it should filter through to the rest of those in a similar situation. If any people do get contacted by a debt collector, then let us know.....

So I am to write to trading standards and consumer direct and cease any payments asap? await to hear from them and then take it from there?

 

One point to make is that I havent actually contacted CT recently requesting a refund as I have seen it as pointless and chose to contact BPF first. Computeach are part of ALOT of 'industry' governing bodies, of which I find probable that they are all in on the [problem]?
