I must ask you to refrain from heading your letter as a final response to my complaint when in fact the opposite exists.

As you are aware I sent you a letter on zyx informing welcome financial services about terminating my agreement. (Copy enclosed)

 

In your response you state you have contacted the mechanical breakdown insurance team as to the malfunction of the fly wheel.

 

You state they have contacted the Vauxhall garage in question to discuss the matter further and that the malfunction of the fly wheel is down to wear and tear.

 

This is down to the independent welcome/warranty engineer report.

 

To confirm this by return, can you send me a copy of the

 

1/ THE WARRANTY INDAPENDANT ENGENEER REPORT ON THE FLY WHEEL

 

2/ THE REPORT FROM THE VAUXHALL GARAGE ENGINEER TO WELCOME FINANCIAL SERVICES/WARRANTY DEPARTMENT CONFIRMING WEAR AND TEAR.

 

ILL JUST MAKE A QUICK NOT ON REJECTING THE VEHICLE UNDER THE SALE OF GOODS ACT AND SECTION 75 OF THE CONSUMER CREDIT ACT 1974

 

IN JUST OVER TWELVE MONTHS THE VEHICLE HAS HAD OVER THREE AND A HALF THOUSEND POUNDS AND THE FOURTH MAJOR COMPONANT FAILURE.

 

I THINK THAT SPEAKS FOR ITS SELF.

 

I AWAIT YOUR RESPONSE

Brilliant, thanks post, as you may have read in my other posts I am having great difficulty at the moment traveling back and fore to work, other people are now having to go out of their way to take me, however as of 1/2/10 I will be on a new site and no-one will be able to take me. I can't afford to hire a car after paying Vauxhall and paying to get a second car going which has now also broken down. I need to take a company car that is being offered, but am concerned at not being able to reject this car, how do you think I stand on this.

They Have A Rather Large Office Whoes Job It Is Is To Reject Complaints And They Are Rather Good At It

 

I Lke The Bit In There Letter About Doing A Voluntry Surender, Get Stuffed To That

 

May Take A Few Months But We Will End This

In That Letter Ive Put Welcome On The Spot

 

They Are Saying The Vauxhall Report Says Wear And Tear

 

You Have A Report That Says The Opposit

my question would be why has the clutch failed and needed to be replaced at only 93188 miles? is this normal? if it is expected for a clutch to be replaced at this mileage then fair enough, but if not and the engineer has stated not driven to excess then I would challenge it.

 

perhaps more research is need on clutch lifetimes for you model.

Hi Dibbo, it,s the flywheel that's at fault, and it's not a consumable part, its like saying the engine has worn out due to wear and tear at 93000 miles, totally unreasonable. The flywheel has no wearing part's, so any wear evident is due to a failure of that part. They don't seem able to grasp that concept, as soon as someone said the word "WEAR" they thought they had a get out. It's such a well documented problem item on all modern diesels I can't see how they can dispute it.
