    • Today as the registered keeper of the vehicle photographed, I received a Parking Charge Notice, for a private land car park. I have looked at streetview and I dont think the signs are noticable, they were not placed on entry to the parking area, but on lamposts around the plot. It's not ANPR monitored but must've had someone on foot as they had photo of the vehicle parked in a bay. Is this one worth contesting or will it have to be paid?   1 Date of the infringement 28/5/24   2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 4/6/24   [scan up BOTH SIDES as ONE PDF- follow the upload guide] please LEAVE IN LOCATION AND ALL DATES/TIMES/£'s   3 Date received 10/6/24   4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] Yes   5 Is there any photographic evidence of the event? Yes   6 Have you appealed? [Y/N?] post up your appeal] No   Have you had a response? [Y/N?] post it up N/A   7 Who is the parking company? Parking&Property Management LTD   8. Where exactly [carpark name and town] 34-39 Magnolia House & 1-83 Cedar House Spelthorne Grove, Sunbury - on - Thames, Middlesex, TW16 7.   For either option, does it say which appeals body they operate under. It doesnt seem to. It states they operate in accordance with the International Parking Community's Code of Practice (IPC). On the back it says "Contesting this parking Charge" and under this heading it states that "all letters contesting a parking charge are carefully considered and replied to within 28 days. Charges are put on hold until an appeals decision has been reached. If we reject the appeal, you will be provided with the contact details of the Independent Appeals Service."   There are two official bodies, the BPA and the IAS.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Gram, if the loan is secured did you get a quiet period of time to consider the loan before accepting?

 

I believe Post is clued up on this but I believe the creditor in such cases needs to stay away from you between the loan offer and your acceptance in order to ensure you are not pressured into taking a loan secured on property. Perhaps Post can comment when the apr check is done. If it's out then you'll be a happy bunny. The apr can be under by 1% but not over by more than 0.1% I think, something like that anyway.

Unfortunately the one thing i do remember is that they did give the cooling off period before they would pay out the loan. I remember this because they kept sending out our quote and we didnt receive it so they had to keep resending it and they said the cooling off period had to start again each time they resent it

Oh good. i hope so :) Not sure what the apr thing means but hopefully that is another good thing.

 

Also, i blacked out the address on the agreement before posting it, but i just noticed when i did this that the address is actually wrong. The 1st line of our address is correct, ie the house number and street, but the town&city are for somewhere in Wales i think - I live in Scotland. I think this explains why we didnt get the paperwork a few times originally (see previous post).

Same wavelength for sure but only because I remember one of your older posts explaining this to another Welcome customer. As such my understanding of this is not as comprehensive as yours, I merely know the basics. Had a secured loan myself actually with our mortgage lender Abbey.

 

I checked the paperwork and saw from the date of their letter offering the loan to the date the money cleared into our account (after they sent the cheque) was literally nine or ten days, all extremely rapid. I wrote to them about this and they stalled for a bit before stating I was incorrect about the cooling period. Not too sure where I stand actually but something I resolved myself to find more about. Keep getting distracted with helping people though! :rolleyes:

The long and short of our situation is that we are currently a couple of months in arrears and had been paying a bit extra each month to help eat into the arrears. We cant afford to do that now and are struggling to make the normally monthly payment so i suspect they are going to up the ante even more now with regards chasing us. We have already received a default letter saying we had to pay the arrears within 14 days etc but they guy i spoke to said to ignore this as we were currently paying more than our contractual monthly payment so it was all ok at the moment. - obviously this now isnt the case as we cant afford it so im really worried about what will happen next and want to fight with fire so that i can get some breathing space here and not be taken to the cleaners by them!

 

Also whether this makes any difference or not i dont know, but it would be pretty poitnless in them trying to force a repo on us as they wouldnt get a penny as we owe more to our mortgage and 2nd charge (Picture) than what the house is worth so there would be no money left to give to welcome if the house was sold.

 

Just thought i'd give you all the info in case any of it helps. and thanks ever so much again.

Gram, out of interest what is the date on the default letter/notice and what date is given for you to comply in order to avoid the default? They need to give you 14 days but many forget to allow for postage time meaning the default is invalid.

 

Could be useful if at any time in the future they start to get really heavy, irrespective of the potential apr irregularities that may surface.

They didn't give a date to comply by, they just said within 14 days which i gather from other posts is wrong on their part - they should have quoted a date.

 

Can't wait to see what postggj's verdict is on the agreement as a whole and the apr.
