I didn't say that I wasn't going to provide documents, only that I will upload them to an online repo that I am in control of, and that I would share links to these. You shall still be able to read and download them no different from if they were hosted here. And, the issue I have is not so much with hosting, but using an online pdf editor to create a multi-page pdf, again I have discussed this that same message.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I find the current state of affairs with the credit industry and the behaviour practiced by those within it to be absolutely indefensible. I've heard people reduced to crying, shambling wrecks because of call jockeys, and it just isn't acceptable at all.

 

The CSA have to make things up and express frustration because they can't justify their existence either. If they were to stick to 100% facts, there's no way they can do it.

 

Remember that this is coming from someone who's seen both sides of the coin.

The CSA has made a huge error by going to the press as that's exactly what CAG needed, FREE PUBLICITY :D

 

Round 1 to CAG.

 

Poor little babies feeling insulted, awww go suck on your dummies and come back when you can play with the big girls and boys :p

 

1st crud, lowlife and Marlin have both been exposed on TV recently by the BBC and look where that got them :D

 

The CSA should seriously re think their boss too. His company is a laughing stock, allegedly, and under sanctions from the OFT!

Laugh , I did a a jig , where do they get off with the moral high ground . Law and morality are two seperate issues , there is no equitable angle within the consumer credit act . Even on a moral level , if I borrow £1000 , pay back £1200 , and yet they want to keep me in thrall to interest for ever , who is the sinner , not me we are on a moral level if I read the contract and decide I do not lawfully have to pay back any more . I love a whining bully .

will be taking this up with my local councillor when i meet him to discuss the halifax charges, my friends impending eviction tomorrow, and now this

Lots of freedom to speak in this country!!! Its just when somebody else starts listening that they get worried, and articles get written in the Gaurdian, and websites are referred to as a 'nemesis' The moral of the story is....well I'm still working that bit out.

Lets set aside the issue of the proposed reduction to the limitation period for a moment and give a little focus on the actual collection of Statute Barred debt.

 

Thanks to my nemesis, the Consumer Action Group website, there is a lot of misinterpretation of statute barred debt, what can and cant be done and the rights of the consumer and DCA.

 

And to make matters worse the Office of Fair Trading seem to have misinterpreted the law also…

Which is what I meant too, so now we are singing from the same hymn sheet onwards and upwards. I wonder what the next move will be. If things run true to form there may be some sort of attack on the funding of this site- this is the usual way that free speech is controlled if it rocks the boat.

So it's OK for these organisations to give advice on collecting Satute Barred Debts but not OK for CAG to tell people what the Law is.

 

Welcome to Feudal Britain 2009.

 

Keep going CAG -- Most people on this site have got into debt because of unfortunate or changed circumstances and certainly can't afford the expensive legal advice that the DCA's get.

 

If it wasn't for EXCESSIVE Charges, Selling Debts on from the original Lender and 2,001 other tricks this site wouldn't be needed - but there are over 250,000 of us so thanks CAG.

 

If the Guradian of all papers has a problem with CAG we are certainly doing all right.

 

I would have thought the Guardian at least would have been one paper to actually SUPPORT CAG. I wouldn't be surprised if the FT (Financial Times) was putting its oar in -- but The Guardian --how things change.
