    • We looked up the e-mail address so communications would be in writing.  If you do stuff on the phone the other party can just deny the contents of the conversation.  They can't deny what's written in an e-mail. So time to sort Pete out.  Check the following for accuracy and change anything I've got wrong.  Then e-mail Pete this evening.  I was thinking of threatening the pub with legal action but let's initially be nice.   Dear Pete, Re: PCN no.XXXXX, claim form no.XXXXX on 23 July 2022 I was a customer at your pub and I attach proof of purchase. I was picking up my cousin Ms XXXXX and her family as she was working as a cook with you at the time.  I entered the pub through the back door, went to the bar, and ordered a drink and a meal.  At no point did any bar staff alert me that I needed to add my registration number or did I see any signs advising me to do so.  I then took a seat outside in a small seated area so I could chat to my cousin while waiting for her to finish work.  We were joined by the management of the pub and bar staff during my time waiting  I was shocked a few days later when I received a demand for £100 from Civil Enforcement Ltd.  i contacted the pub and was told "don't worry, it's not enforceable". Well, that information turned out to be nonsense because I have now received a county court claim form from CEL. I contacted the pub again on XXXXX and was extremely disappointed to be told "there's nothing we can do". Of course there is something you can do.  You are the organ grinder.  You called CEL in.  You can call your dogs off.  Your pub has absolutely superb reviews on Google Maps regarding the way in which you treat guests.  Do you really think customers should be dragged to court?  I'm sure you don't. I am therefore requesting that you intervene and instruct CEL to cease court action. Yours, XXXXX

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I you are talking about Wageday Advance I have just made an agreement to pay them back £30 a month and they have accepted and asked when would I be making the payment. Most payday loan compaines say that but I don't listen to them they will pass you on to a DCA who you will have to deal with just stick to your guns and let them know £20 is all you have and go to hell they have made enough money from us with the hgih interest. I also done the same with Poundstillpayday they passed me on to a DCA called Clarity who are quite understanding and have accepted a £10 payment per month for a £920 debt.

 

Don't worry about these clowns.

Hi Guys,

 

An update for you, I 've just got off the phone to Wageday and they've accepted a repayment plan of £25 per month with no fuss whatsoever.A lady called Liz Berry was very helpful setting this up for me.Thank God for this.So im still waiting for PDU and EPDL now....:confused:

No probs, by the way I am on Channel 4, Despatches 7th Dec all about these payloan companies I myself have saved £200 per month just rolling them over, I have 4 PDL's. 2 of them I have arrangments with the other 2 I am waiting for the s--t to hit the fan. LOL

Go for it!!! These companies are no better than loan sharks IMO, interest rates extortionate, perfect for vulnerable people who cannot get credit elsewhere and are desperate! I will be watching with great interest on the 7th!

Door to door? dont think it can as it is the same as a doorstep visit!

 

Maybe you will have better luck paying through a dca if that is your intention, you need to decide what and who will put the most pressure on you pdl or dca? then just sit tight and await their contact.

Sorry to intrude but PTP will pass you on to clarity who are very good I am paying them back £10 per month for a £930.00 debt just ignore the stupid threats from them and wait for Clarity. I did this by e-mail only no tel contact at all.

Just stick to your letter and let them do the running, at least you know they will accept monthly payments, if they dont then let them take you to court and the judge would rule in your favour..imo.

Im SOOOOOOOO ANGRY with EPDL, they have used some old cheques from my previous experience with them and tried to cash them on my lloyds account, i got home last night and received a letter from lloyds saying the cheques bounced( 5 cheques of £100) SO NOW IM going to incur a unpaid cheque fee of £20 each cheque and also because i asked LLoyds to put a stop on the cheques i also have to pay £10 fee for each cheque so that adds another £150 to my debt.IM SOOOOOO ANGRY with EPDL why did they do this????? The only thing that is going through my head at the moment is to email them and tell them BECAUSE OF THIS TROUBLE YOU HAVE PUT ME IN, IM NOT GOING TO MAKE ANY SINGLE PAYMENT TO YOURSELVES EVER AGAIN.

Please can you tell me what should i do now? I dont understand why they did this if they have contacted me with regards to setting up a payment plan, and they basically go behind my back with some old cheques (that they said they got rid of last year)??????

Did you not close your account? dont call them as you will ' go mad ' as I have just don with BLS(TSB). stay calm and put a letter together and send it today .

Hi All,

 

hope u're all ok,

 

just to give you some updates, so far EPDL, Wageday and Payday Express have agreed on repayment plans, still waiting for PDUK and PTP.

PDUK and PTP have said that they would pass this to a DCA (last week) so far no phone calls or emails about it.

 

Ill wait... no rush :rolleyes:

I'd get all the proof that you paid back the loan to them and the copies of the cheques they tried to present and take it to the police station and report the matter as fraud, that is what it is, pure and simple.

 

As the local police to put you in touch with the Moneylending unit, they may not know what you are on about but push the position to them that fraud has taken place and you want action. Take the names of the people you deal with at the police station and you can complain about them if they are obstructive and say 'it is a civil matter'.

 

Stress that you are feeling harrassed and vicitimised and threatened by the tone of their letters and emails and phonecalls and they should try to do something.

Happy Holidays Everyone,

 

Im so ****ed off at Clarity, PTP have passed my debt to them, I know some of you guys have dealt with Clarity peacefully but the lady that answered the phone was very rude and SHOUTING at me saying "Why in the hell do you think that £10 per month is reasonable" for a debt of £578?????" so i just put the phone down on her and emailed them saying i will not tolerate this king of atitudem and stuck to my repayment offer NOT NORE NOT LESS...

 

Im so stressed i dont need this at this time of the year.

 

PLEASE HELPPPPPPPPPPPPPPPPPPPPPPPPPPPPP :mad:
