      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I had a call the other day from a salesman from a company called capital returns who asked me if i had any loans, ppi etc, so i stopped him and told them i knew all about that stuff and had already CCA'ed and claimed back everything i was entitled to. I was then asked if i had a mortgage and he said that the brokers fee and arrangement fee can be reclaimed, and as my mortgage will take me into retirement, it was sold to me illegally and i am entitled to compensation. He seemed really confident about getting loads of money back and asked if i would like them to act on my behalf and when i agreed he told me there would be a £995 upfront fee! So i suggested that if they win the money they can take it out of that, apparently their solicitors don't work that way... :rolleyes: Seems all very fishy to me. Has anyone heard of Capital Returns? Their website doesn't give much away. What about the money he said they could claim back and telling me that my mortgage was mis-sold to me as it takes me into retirement? Does anyone know if theres any truth in this?

The upfront fee payment is the giveaway! If they were confident you were mis-sold a mortgage and you had a very strong case, then they should accept their fee from any compensation. In any case, why a fee? If they are solicitors and your claim is upheld, then they can claim their legal costs for the case. Perhaps they are not that confident. Avoid like the plague.

hi,i too had the same call,being 70yrs old i fell for it,he offered me the same as you,plus i would recieve £11,000plus,so i paid £95,sent them the info they needed,they said they would contact me in 2wks,no reply.i tried to phone them,no answer,i have an appointment with my bank to change my details

H, DONT GO NEAR CAPITOL RETURNS THEY ARE A TOTAL RIP OFF!!!!!

 

I was approach last April by this rip off company sayin that i would get in the region of 15k back for PPI within 6-12 weeks after this time had pasted i struggled to get in touch with this company as the phone is permentantly engaged i also have written over 10 letters trying to get back my £995 that i had to pay for them to take my case.

I received a letter today saying that there was no way i would get back my money so now it is in the hands of my solicitor.

 

I was totally mis-sold their service and am now in dire straights and fuming!!!!!!!

 

As i have said DONT GO NEAR THIS COMPANY THEY ARE A TOTAL CON AND THEIR CUSTOMER RELATIONS ARE SHOCKING!!!!!!

Am trying to get my £95.00 refunded and it is proving rather difficult but am just going to keep annoying them till I get it !!!!!!!!

 

We should be able to report this company to some one it is so unfair what they are doing!!!!!!

 

Am a single parent who works hard to earn my money and £95 is a nearly a day and a half’s pay to Me.!!!!!

We stupidly went along with Capital Returns paying a £995 back in August, they are very amateurish, wrong names on letters etc. They have now said that they have transferred out account to a company called Bank Smart but nothing said about the £995. I am waiting for them to reply to my mail. I presume they have found there is nothing to be made on our account and so are passing it on and keeping our money. Will keep you informed as per our progress

Hi like many of you, I was conned by Capital Returns, I paid £95.00 upfront last September, I then decided not to proceed, I didn't sign anything, simply returned all the papers, which were wrong anyway, they were wanting me to claim on my present mortgage instead of the one they'd mentioned, when I questioned this, they argued that it was the same company, (I really don't think so), but may as well try to claim from this one anyway!!

I had a letter from the the 9th October, 2009, to say I would receive a refund within 14 or was it 21 days, still waiting.

So I've been in touch with the Minister of Justice who said they are dealing with many claims against this company, advised me to write another letter, (I did this in December) and tell them I wish my refund to be made within 14 working days or I'll be taking further action, he also asked if they had permission to act on my behalf. If I do not get my refund with this, then I have to contact the MoJ again.

One big problem, the only letter I had from Capital Returns I sent to the MoJ, and now have no address for them, he did tell me it's

 

417 - 419 Shelton New Road, Hartshill,

 

but don't know any more than that, does anyone else have this address for them?

obviously alot of other people being ripped off, try calling the directors!!!! Roger Simpkin -

Try giving them a call for your money.or look up the company on companies house for director addresses etc

 

if you are unhappy why not try contacting dennis at home,

Told today by the Ministry of Justice they have stopped Capital Returns trading, so I guess any chance of us getting refunds is virtually nil! Thanks goodness it was only the £95 I paid, and not £995, I do feel for all you people who have lost this amount, I'd be totally devastated.

it is interesting that the moj let these guys and others like them trade, and knew what they were doing. maybe you could charge the moj for your losses??? i am not sure, just a thought that they must be responsable for somthing.

I too have been duped, im so angry, both with the MOJ and myself. I coughed up £995.00 on my credit card.

I've sent letters and rang Capital (no answer), i'm awaiting an email from MOJ other than this im gutted, getting married in 2 months and could really do with this money....

 

Is there any way i could get this amount back?

It may well be that because you paid by credit card theat your credit card company has liability. Check out the rules regarding this. You may get a 30 minute free slot with a solicitor to discuss your problem.

as i said before, i think it is about time that the MOJ and their staff took a look at their invovment in all this mess.

the were call the dca and spent a lot of money forming the moj who i belive were burton on trent trading standards.

they i think were to busy taking fees and regrestrations of these cmc`s (and con men) to realy pay full attention what their job is.

they must to some degree take some responsabilty for letting companies like capital, cartel, cck all set up and trade for 2years without stoping it if it was wrong, maybe it was just the case that the moj had not the correctly informed persionel to do the job and its taken them to long to katch up? i dont know but that is a prity poor excuse for losing thousands of people millions of pounds. if they had been on the ball it should not have taken them this long to find out who the crooks are and stop them...i think all of you who have lost your money should be sending lots of letters to the moj and ask them if they will refund your fees and see what they say after all they are the regulator and it is in a way their fault.....

its also funney how quite it has gone now about cartel client reveiw, capital and credit card killer,,,,,where have they gone???

 

again guys i am sorry for you who have lost money but the moj should shoulder some blaime as they not only authorised these companies, but took fees of them and sat and watched while rome was burning..
