      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

A huge amount of info on here, I am getting a bit confused.

 

I am £25,ooo in debt, two debts with Lloyds... one for £10k and one for £15k. a few months back I was offered settlement figures.

 

£4500 for the £10k one. And 10k for the big one, but only if I paid it within a week.... not going to happen that one. I almost managed to get the money for the small one but had an accident, £3k went on my work van. And am now getting phone calls from a scottish man telling me to borrow off friends and family or else... I do not get phased by this but it is annoying.

I have had this over my head for 5 years now, I am self employed and have a few times missed payments as I simply ran out of work and if honest not the most organised person.

 

Do I keep paying the monthly amount even if the debtors are telling my payment plan has failed???

 

I have NO money this month... due to my van being repaired and losing 3 weeks work.

 

What is the WORST they can do?? My credit rating is zero any way, I have no mortgage or kids or anything really.... I am tempted to just file for bankruptcy but I stumbled on this web site....

Hi Flick 46 and Welcome to CAG :)

Others will jump in to help too, but in the meantime, when roughly were the debts taken out?

Were you sold Payment Protection Insurance with them?

 

Main rule: NEVER speak to them on the phone..they are breaching Office of Fair Trading rules by asking you to borrow more to pay the debt.

Keep everything in writing with these people as they will lie and bully on the phone to panic you into paying.

As ODC says, make them prove the debt by sending a request for a copy of the credit agreement. The template letter is HERE

You need to enclose a PO for £1 with each request (no cheques!) and print, don't sign your name on the letters.

They have 12 + 2 working days to supply it. If they don't, after this you can put the account into dispute and legally withhold payment until they do.

The worst they can do to you at the moment is take you to Court, where a judge will only make you pay what you can afford to pay.

Tell them to leave as you have nothing to discuss and all communication must be in writing.

 

Tell them you will call the police if they don't leave immediately.

 

Remain calm and polite at all times.

 

Walk away from the door so the visitor cannot try and talk to you.

 

If they don't leave, call the police to report that you are being harassed and the visitor refuses to leave.

First thing is to request the CCA docs they may or may not have

They have 12 workings days from receipt to deliver them to you. If you get them, post them up on here after (removing all personal details) & be guided as to the enforceability of the agreements.

Do you have PPI as part of them as most policies don't cover the self-employed.

Next time the ignorant Jock rings hang up. He is breaking the OFT Guideline by telling you to borrow money. The easiest way to sort these muppets out is to send the CCA letter.

Get off your soapbox. This was not nor was it intended to be a racist remark and I resent your accusation. I was referring to the person who phoned up and only him and certainly not the Scots as a race. I am of Scottish descent myself and do not think Jock is a Racist name nor is Taff or Paddy.

Hey .... These loans were taken out in 2003 I think, and yes I do remember a payment protection something or other being taken out too. Excuse my vauge memory, as it was a while ago and my lack or memory and paperwork and letter opening got me in this mess...

 

As it stands today - Acc no 1. £13,000 with BLS collections. To pay £300 to keep it on track, missed last months. Current agreement is £150 per month.

 

Acc no 2. £10,000 with Allied international. Scottish... err.. bunch. Call me ALOT. Stopped answering now. They are demanding a £2000 deposit this month then £150 min each month or will issue a CCJ.

I simply do not have that sort of money....

 

These are BOTH loans. BOTH from Lloyds... even when I was having trouble they gave me more money.... one was a Business loan the other was a personal loan to help the other one out, they said at the time.... I was young and so stupid.

Hi Flick,

As above, you need to send a Consumer Credit Agreement requests by Recorded Delivery to whoever is chasing you for them now. Remember not to sign anything.

After 12 +2 working days you can legally put the accounts in dispute and cease payments if they don't comply.

A CCA request will stop AIC taking any kind of adverse action.

 

However, this won't stop the automated silent calls (when are AIC going to get fined for that?), though after you get about two or three of them and not respond, they'll stop.

 

If they phone and you do get a human on the other end (used in broadest possible terms!), refuse to confirm or discuss anything with them. You don't have to justify/explain/excuse or tell them anything verbally besides 'In writing only!'.

they can demand what they like you can only pay what you can afford, they also cannot issue a ccj only a court can do this, this is simply nothing but demanding money by threats.. personally Id report them for it..

Flick - only a court can issue a CCJ & you're a long way from that so please don't let that worry you.

 

Send the CCA requests & see what you get back after 12 + 2 days.

 

As far as anyone else not knowing, don't worry cos they won't know unless you tell them :cool:
