    • That's fine.  The important thing is to show Kev you're trouble and so best to drop you like a hot potato. Invest in a 2nd class stamp tomorrow - all Kev is worth - and get a free Certificate of Posting from the post office.
    • Do not under any circumstances plead guilty until we know what we are dealing with. It's a sure way to 9 points. The tried and tested way to handle this is to plead not guilty to both charges and offer to plead guilty to speeding provided the "Fail to give information" charge is dropped. But I am concerned about this "ticket refused" sticker. I've never heard of this before. A "ticket" is not a term used in connection with speeding offences. There seems a distinct possibility that your response was received by the police but one thing worries me: I've never heard of a sticker being placed on a response and it being returned "Return to Sender". t's just not what ticket offices do. If you could post a picture of this document and the sticker it might help.  If you can show the response was received you may have a defence to the "Fail to Provide" charge (provided you completed your response properly). If the police are saying you did not respond they cannot succeed with a speeding charge (as they have no evidence you were driving). But if you did not respond, who put the sticker on the document and sent it back yo you?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

Like many other people I have had to complete a new assessment form for IS. I also receive DLA - High Mobility, Middle Care. I completed the said forms and sent them back some 6 weeks ago but have heard nothing since. I am on quite high doses of morphine at times and inject a cancer drug weekly along with a long list of other medications.

 

Will I have to be seen by one of their Doctors ? If so, when will I hear from them ? Or do you think they will accecpt my statement and completed form ?

I would have thought that with your diagnosis, it's unlikely they'd decide to get you to see a Dr, but what do I know? :rolleyes:

 

Either way, they also work at their own snail pace. When my friend's son lost his IB, it took them about 3 months just to set the Dr's appointment for the appeal, (that was in February) and he got the decision to reinstate it months later, and to date, he STILL hasn't had the whole of the money backdated.

 

What I am trying to say is that as well as the morphine and the cancer drug, you are going to need large doses of patience just to keep you going with that lot. ;-)

No truer words were ever spoken Bookie ! and patience is something I do not have a lot of these days. I could start an arguement in an empty room !

 

Having thought about it, it is IS......think the mind is going as well :D

 

Oh well I could do with a fight if they decide I am fit enough to work. All I will say is 'bring it on' !

 

I think there are a lot of other people they need to look at before me and your friends son but that is another story and I have had too many posts deleted lately............I am trying to keep my head down :rolleyes:

Oh... IS, I don't know, hun, sorry. I am glad to say I haven't had to deal with that lot for many years and that is probably responsible for my blood pressure going down faster than ever. ;-)

 

You could try giving your local office a call and see if they can give you an idea of their timescales.

The indicator of delay for IS cases is two months.

My advice is based on my opinion, my experience and my education. I do not profess to be an expert in any given field. If requested, I will provide a link where possible to relevant legislation or guidance, so that advice provided can be confirmed and I do encourage others to follow those links for their own peace of mind. Thought I would update this thread.

 

I received a letter on Friday morning to say that I had scored high on my points (?) and that I would not have to complete any more forms until 2012. My benefits will continue until that time.

 

Thank god for that but I would have taken it further if they had failed me.

Thanks chuck I am glad it has turned out like this and I don't have to fight again for what I am entitled to. Sometimes you just don't have the fight in you and that is how I feel right now so thank god someone was watching over me for once.
