it would be one agreement prob a carbon sheet for three copies

yellow copy

blue

white

not sure on the colours

 

the dealer gets one copy

the finance co gets another

and you the final copy

 

there is allways only one agreement unless you re-write the loan

Yes, thats what I thought. They've definately faked the signature then.

 

My guess is they've lost/misplaced the original agreement and knocked this one up as a replacement. :mad:

 

That explains why the welcome staff I dealt with were so keen to know if I already had my own copy of the agreement before they'd send the new one out and if I did could I please bring it into the office. haha. I said I had lost the original ages ago :p and now i get this lovely fraudulant one!

im in the exact same situation,option fee being charged interest on and none of my agreement is signed by welcome and is not dated at all! really need to know where i stand on this as we are thinking of sending our car back as we can no longer afford it...any advice welcome! thanx

Send off a cca request and see what you get back and if it matches the agreement you've got to start with.

It'll come with a statement as well so you can check for any charges etc that have been applied to your account.

 

Did you take out any of the insurances with them? We were told we had to or no car so i'm going through the process of reclaiming them.

we did take them out but then cancelled them within the 30 days so never paid a penny for those. for the cca request do i just write them a letter asking for it or do i need some sort of form or something....they seem impossible to contact,we get phone calls from our acc manangers personal mobile and home numbers,she even txted us a while ago to say theyy had recieved a payment...very odd. we have an appointment with cab next week so hopefully they can shed some light on all this.

For the cca request I used this template just remember to send the £1 postal order and do NOT sign the letter, just print your name as they seem to do dodgy things if they have a copy of your signature, oh and send it special delivery so you can prove you sent it and keep the tracking number. They have 12+2 days to respond. :

Re:− Account Number:

I do not acknowledge any debt to your company.

 

With reference to the above, we would be grateful if you would send us a copy of this credit agreement, statement of account and notice of assignment.

 

We understand that under the Consumer Credit Act 1974 (Sections 77−79), we are entitled to receive a copy of our credit agreement on request. We enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act.

 

We understand a copy of our credit agreement should be supplied within 12 working days.

 

We understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

 

We look forward to hearing from you.

this may sound like a pretty dumb question.......our credit agreement was signed in 2008...does this mean that i cant do anything about it???? i keep reading about agreements that were made before 2007 being unenforceable but nothing later....anybody know???????

hey another question, sorry that there are so many, i've been reading alot about the dodgy insurances and rang direct group asking for details on any insurances they hold in our my partners name.

 

They said he had PPI but didn't mention my mechanical breakdown or shortfall extra. At first I thought this may be because these two insurances were held by another insurer? But after digging out my mechanical breakdown policy booklet i've noticed it gives direct group and norwich unions details....

 

Does this mean there is no mechanical breakdown or shortfall insurance...even though we've been paying for it for 3 years??

 

Sorry if this sounds silly or if i've missed something here.

Did anyone else fall for the old 'any old car as a deposit' advert when they decided to use Welcome?

 

We did and they did not accept our car as a full deposit...they gave us £1 and we had to pay £50 cash as well.

 

I've been digging around in some old paperwork, they took my car to auction after and recieved about a hundred quid for it. This annoys the hell out of me.

 

Maybe i'm being picky here and I wouldn't mind if they'd just took the car as the deposit but they took £50 off us aswell!

 

The car was more than enough to cover deposit.

 

Surely the any old car as a deposit is false advertising then?

I have two agreements. The one I was given, and the one they sent me after cca request.

 

On my agreement: Insurances are added to the total cost, the figures are all there under insurances HOWEVER, the tick boxes are not ticked.

 

On the cca request one: Insurances are added to toal cost, figures are all there AND boxes are ticked.

 

That any help?

Seems To Me You Have Been Duped On The Insurance By Welcome And Welcome Have Not Paid For Them

 

On The Stuff You Got Back From Direct Group And Welcome

no, all I got from direct group them was a photocopy of whats included, terms etc.

 

No policy number

No statement of price.

My name is nowhere on it.

 

From welcome I got a credit agreement and a statement that dates back from when I took the car. Terms and conditions, and a sheet with my details saying, customer number, broker number, name address etc.

You Need To Send Welcome A Letter Saying The Statement Of Price On All The Contracts Has Been Neglected In The Documents Sent To You

I've heard about these pre-contract agreements, apparantly you get it before your credit agreement (I didn't though!).... usually they say, 'for your information only'.

 

This isn't your credit agreement, you should do a cca. I bet they don't have a signed credit agreement from you ;)

Weve Since Had This Modified As We Couldnt Afford The Repayment The New Paperwork Is 3 Pages And That Also Says Pre Contract Information....none Of This Is Signed Or Dated By Us Or Them And Does Not Even Have Anywhere To Sign It
