I am currently pursuing a claim against Northern rock for recovery of charges on my account and received a letter containing the following.

 

1 Charges on the account are charges for services and are not default charges, or put another way ,they are not charges that arise from breach of contract and a therefore fully enforceable by law.

The charges I am pursuing were for unauthorised overdraft or unpaid cheques. (£30 each)

 

Is there anything to this? As as far as I can see the charges woulld not have been made if the contract had not been broken.

search the forum material for "cloaking" you should find a lot on cloaking penalties.

Have read and you will then understand your position
