hi

a while ago i posted a thread about my son who used to go to private school he was 9 when he was told to leave because mummy and daddy couldnt afford it. (so we were threatened this would happen by the owner who is prospective mp for a town in norfolk.) !!

anyway we are in court tomorrow as the school want a terms fee in lieu of notice which is £4,000 approx. anyway we had school fee insurance which we paid termly and tried twice to claim on and well i think we all know the story couldnt claim my partner did not qualify he was not employed, he owned his own company and he was paid with dividends not p 45 never got a p 60 either. he had to sign on and we had to wait 90 days but how could we pay the house etc anyway.

the upshot is we put in a counter claim for the misselling of the payment protection insurance, it was part of the schools terms and conditions at the time so therefore we never had a choice. Since we started this action we have seen a number of adjusted documents by them to suit their case which does not correspond to some of the originals we have (my son went there for 5 years and he was told to leave within 3 weeks of non payment of the term) his treatment was terrible by this private school and offered no payment options for us they just threatened us by using him. eventually got him in a good state school which took a fight lasting 8 months which he was at home with me trying to educate him. he is now being statemented as he even at the private school was stated as being dyslexic (i hope ive spelt it right) they now havent even passed his school records to his new school because of the court case. We are up against big guns as the insurance is with the HSBC and my partner the other day phoned asking without giving his name about qualifying for the insurance. HSBC have now threatened us in relation to this phone call to take us to court over this.

the claim is in a small claims hearing and we have just received a bill which if we lose and they suspect we will and i quote this from their previous letters , just given us a copy of a bill for their solicitor and barrister and attendance even though they cannot claim it in court only fees for over 6,000.

I honestly think im onto a big on here

anybody know about this any advice or comments
