    • for the sake of history, i've merged your old sadly failed charges reclaim court claim. have they ever sent you a default notice regarding this mortgage? dx  
    • I am financially at  point where I can see the light at the end of the tunnel regarding my debts. I have one remaining and I am interested to see what my options could be. I have be in contact with the Citizen’s Advice Bureau and the National Debt Helpline, but their advice has been a little more generic (but still helpful). This debt is 12 years old and is now owing around £3k. It was a bank loan and has been passed to several creditors over the years. A payment plan has always been in place and is up to date. I get statements every 6 months. There has never been a CCJ. I have been sent the letters advising of change of ownership. Following my own review of my finances, I decided to contact the current creditor to see if they have a copy of the credit agreement. I regarded this as due diligence as the debt has been sold on several times. The creditor updated me several times saying they had requested the document from the original lender. After 12 months of this they wrote to me saying they had not received it but were still waiting and would send it once received. The last letter was over 6 months ago. I then submitted a freedom of information request to the current and original creditor. The original creditor supplied one, but the current one did not include one in the pack they sent me. I went back to them to ask specifically about this as it was what I requested in my request. They replied saying the debt was sold to them as one without the credit agreement and they did not have it. They have requested it above, so I believe that means they cannot obtain it either for the FOI request. I contacted the original creditor and exercised my ‘right to be forgotten’, under the Data Protection Act, which they have complied with. I also got my up to date credit file and this debt is not showing on it with the current creditor or any others. I contacted the creditor and made them an early settlement offer. They do have an early settlement offer in place on their portal, but I was advised to try to get a reduction via negotiation. I have not heard back from them yet, but I understand through a separate upheld compliant it has or will be refused. Due to this complaint and the creditor putting the account on hold I had stopped payments, and advised them of this. To date, they have not contacted me about resuming payments since the complaint is resolved, but it has only been a few weeks. I am annoyed that they were not honest with me about not having the credit agreement, because that is not being transparent and I understood they should tell you if they do not have it.   I have two questions (but am open to anything else anyone would like to add): 1) Based on the above, does anyone think this account enforceable? I do not think it is? 2) Does anyone have any suggestions on how to proceed? I could resume payments and then settle early. If the above had not happened, I may have just done that. Thank you for any help or input anyone can provide. It is appreciated.
    • The main thing is to stop shoplifting because it could be worse next time. If you think you have mental health issues that led you to do this, please go and have a chat with your GP. They won't judge you and should be able to get you help if you need it. HB

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just a couple of questions.

 

Have they supplied all the statements from inception of account.

 

Also, Rhia advised you to send an addendum to the CPR18, in respect of the Deed of the Assignment. I take it that hasnt been received yet?

 

In post 37 you had some queries regarding interest, it will be interesting to see the statements to see if that tallies.

CitizenB I think you're thinking along the same lines as me. Charging 49% interest and there seem to be penalty charges in there it may well be that the alleged debt is a nonsense anyway when everything is totted up.

Don't panic - it's just the AQ and you need to answer as follows:

A. No (decided don't ask for a Stay)

B. Yes (if you want to change to local court - explain you are a LiP and do not have the resources that Cabot has being an international company (Jesus wept)

C. If it is under £5k then Yes to Small Claims

D. No (unless you have a witness apart from yourself)

E. No ( ditto)

F. Any dates to avoid - holiday, hospital or other

G. Any other info (no need to complete) have suggested adding re my post above.

 

That will give you some breathing space and you don't need anything else yet.

 

OK. Can you SAR Vanquis to see if those alleged letters turn up. Obviously this is no good for AQ but you will need to see if they are in their files or if these are just Enid Blyton creations. Will send them another one tomorrow... just sent me their list of charges & dates with the last SA req, - and an offer to refund them.... noticably that letter is missing from the bundle:rolleyes:

 

If it was done online then I guess this is not a strong part of your defence. I am not up on online appns so perhaps someone else can help.

 

The default notice dates need challenging and I would put them to strict proof as to the actual date this was issued as one way or another this makes the DN invalid. Cabot never have proper copies of letters just "representations" of letters they allege to have sent. Put them to strict proof of the issue by asking for original default notice and proof of posting.

 

Then just read and re-read the whole thing and try and trip them up. Don't panic at all.

Hunni are you saying you have a SAR fom Vanquis? If so is some info missing? Reason I ask is you don't need to SAR them again and another tenner (unless it was done years ago).

Just write back to them and refer to the SAR and state that they haven't fully complied as such and such and such and such are missing. You could also add that if they are uanble to produce any specific item requested then they need to state so, so that there can be no misunderstanding.

Give them another 14 days to respond (and tell them you are doing so on top of the 40 days). If they don't respond in that time then complain to ICO.

As Vanquis isn't part of the court proceedings I don't think you can Part 18 them - although if anyone knows anything different I would be interested to hear as getting the OC involved is often nigh on impossible.

If they don't respond in that time then complain to ICO.- I did send Vanquis a SA request, but I had used a template that only asked for details of the charges, realising my mistake a couple of days later ( see earlier in this thread) and rather than confuse the issue by sending a second one I was advised to send a SA request to Cabot, which I did. That is who the bundle came from yesterday.

The CPR requests were sent to their (cabots) Solicitors, 1 x CPR 31.14 1 x CPR 18 and 1 x CPR 18 addendum for the deed od assignment/ bill of sale..... none of these have been responded to.

can anyone point me in the direction of an example of the 'other information' response for the allocation questionnaire where the other sides solictor has failed to respond, or even acknowledge receipt of CPR requests?

If the court is in agreement, the defendant respectfully requests that special directions may be given as per the attached draft order.

 

The defendant proposes these directions in mind of the Overriding Objectives, and in particular the duty of the parties to help the court further them. The issues outlined below are the crux upon which this claim rests, and the proposed directions identify these issues and will allow them to be assessed in advance of the hearing so that this claim may proceed justly and expeditiously;

 

Without production of the requested documents, I am at a disadvantage and am unable to serve a proper defence. Failure of the claimant to supply the requested documentation will make the case much harder for the court to deal with as without production of the requested documentation will inhibit the courts ability to deal with the case.

 

The House of Lords in the case of Wilson v First County Trust Ltd - [2003] All ER (D) 187 (Jul) made it clear in paragraph 29 of LORD NICHOLLS OF BIRKENHEAD judgment

 

29. The court's powers under section 127(1) are subject to significant qualification in two types of cases. The first type is where section 61(1)(a), regarding signing of agreements, is not complied with. In such cases the court 'shall not make' an enforcement order unless a document, whether or not in the prescribed form, containing all the prescribed terms, was signed by the debtor: section 127(3). Thus, signature of a document containing all the prescribed terms is an essential prerequisite to the court's power to make an enforcement order. The second type of case concerns failure to comply with the duty to supply a copy of an executed or unexecuted agreement pursuant to sections 62 and 63, or failure to comply with the duty to give

notice of cancellation rights in accordance with section 64(1). Here again, subject to one exception regarding sections 62 and63, section 127(4) precludes the court from making an enforcement order.

 

Its is respectfully requested this case be allocated to the small claims track, it is a straight forward case and is easily resolved on production of the required documentation by the claimant, should the claimant not have the documentation required to progress this case I suggest that there will be no case to answer

 

Therefore it stands to reason that these documents must be disclosed before this case can progress any further

 

Draft Order for Directions

 

1 The Claimant shall not later than 4:00pm on (date) (being a date 2 weeks from the date of the making of the case management directions) file and serve a verified true copy of each of the following documents mentioned in the Particulars of Claim

 

(a) the executed regulated consumer credit agreement made between the defendant and xxxxxxxxxxxxxxxxx under reference xxxxxxxxxxxxx together with any terms and conditions that applied to it, the original document must be brought to the hearing.

(b) the default notice together with proof of service

quick thought... can I add to the AQ with an addendum? Will be putting in an application for counterclaim soon anyway...

I take it you want to send the extra info. Send it anyway Hunni and give profuse apologies to the court for it's delay. It's only a week isn't it?

Just do the whole thing again head it revised and send it in. The courts give lots of leeway to the professionals I have found whereas we LiPs go by the book.

haven't got another AQ to fill in, but I do want to add the other info, and also ask for an order for the documents that are missing, so I'll put something together and post it up over the weekend, I'll hand it to the court on Monday.

received a letter this morning from Cabot re my CCA request....

unable to provide info requested, therefore will continue to suspend all collection activity on your account until this information is supplied to you.....

 

I'm guessing they haven't told their solicitors then, as the case is definitely going forward. (AQ submitted 03.08.09)

 

so do I just ignore this and keep at them for info, or sit quietly and wait for the court response to the AQ stage?
