I don't think it can do any harm, but remind them that you don't want a set of their T&C's - you want a copy of the actual credit agreement.

 

Could you also ask what department the contact is in.

is most of this application blank or have you edited it to remove text ?

 

If you have not then this is complete junk also it is only an application for no Apr info or other proscribed terms from what i can see.

what do i tell the fos, who want me to agree that this is an executed agreement?

 

All you need do is thank the FOS for their intervention which has prompted BC to send you the document, which they previously refused to do.

 

It is NOT up to the FOS to determine whether the "agreement" is enforceable or not.

 

Clearly the document supplied is not an enforceable agreement and it is now up to you to decide what to do from here. Possible reply to BC is here - http://www.consumerforums.com/resources/templates-library/86-debt-collectors/582-possible-letter-when-a-questionable-agreementapplication-is-sent Adapt to suit as required.
