      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

being called by DCA what to do?

Hi,

I am being contacted by several DCA's about my credit card debts. I requested CCA's from the credit card companies but all but 3 supplied what they say are CCa's but infact are Applications for credit. All the others have not sent me the executed CCA's. My question is what do i do about the calls, they have just started comming once i sent account in dispute letters to all creditors. Do i answer the calls or ignore them. Do i send for a SAR or just sit back.

If you have a BT line you can use "Choose to Refuse" then for a small fee added to your phone bill, you can block their numbers.

 

If one does get through, just say, "I will only communicate with you in writing." Then put the phone down.

 

Also send them the harassment by telephone letter that's in the templates library. I've found it works better if you head the letter in bold type. "FORMAL COMPLAINT"

 

Then the DCA drone who opens it, is in no doubt they have to put it in the complaints pile for someone higher up to deal with.

I answer them in French or Hungarian or if I am looking to annoy them when they ask to confirm my date of birth I say ok tell me what it is and I will then confirm whether you have it correct.

Then they bluster that I must call the bank and I tell them they cannot tell me what I must or must not do.

At that point they give up.

 

Now you may consider winding them up a waste of time but while you are wasting their time they can't call someone else.

I didn't send the letters you have said only the in dispute letter, i will send them the letters you have indicated. I am concerned that although alot of people on this site state that an agreement is not enforceable if there is no CCa but having a look at the legal issues threads alot of people have said that the judge has ruled against them dispute not agreement being shown in court. If the law states that an agreement must be available them why are these judges disobeying the law and why is no one contesting their judgement.

it depends if you contest it & appear & also the age.

from about 2007, most cca's are generally deemed to be correct.

 

but i wouldn't worry , it will take an awful lot of work to take you to court, and dca's very rarely succeed.

the oc might get away with no cca but a dca willl not.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Get caller display, the service is free but you will need a phone with a display, these can be picked up quite cheaply if you don't already have one, then all it takes is a glance at the display and ignore :)

 

You will find they get very sneaky, I use chose to refuse, and anonymous call reject to but some numbers still get through the 'unknown' and the 'International' but a combination of these three, or just the first will ensure you never have to speak to them again.

Can I just ask...you say from 2007 most CCA's are deemed to be correct. I have some credit cards which were applied for in late 2006. Up until now I have held the belief that if an agreement was post April 2006 then you cannot challenge it?? What exactly changed when the CCA 2006 was applied??

you can challenge any cca

but i read on here one of the more clued-up members stating from about 2007 certain things changed which tightened up some loopholes.

With regards to the phonecalls, if you have caller ID, just do what I do and answer the phone as if they've got through to Ofcom. Say: "Hello thank you for calling Ofcom telephone harrassment advisory team, my name is *insert made up name here* are you calling to make a complaint about harrassment?"

It works a treat. I don't know if it's really allowed but it's always worked wonders for me. Of course, send the harrassment warning letters. But a lot of DCA's will still keep phoning for a while.

Hi,

Section 127(3 to 5) was repealed. I believe the date was 1st October 2008.

There were many changes which affect the "older thread" defences.

Not the least of which allows creditors to claim "arrears" without many hindrances.

I answered the phone saying 'Ayatakadai'... which is a Japanese weaving loom... and the person the other end said 'Please don't swear at me'. I said 'Suimemasen' (excuse me in Japanese) and they put the phone down. As they didn't immediately call back on my mobile I knew it was a DCA...
