Where I defending a consumer who had been 'arrested' by a security guard then the guard would be in for a hell of a time in the witness box. A citizens arrest only ever existed for the casual passer-by - It does not exist (although some like to think it does) as part of a security guards job description & if their employer advocates that it does they are misleading their employee

Oh & as for the remark about a warrant card. Without it in his possession a police officer has no more power of arrest than an ordinary citizen - once upon a time a police officers warrant was his truncheon which was inscribed as such

Really,so where in PACE it says "any person may arrest.." where does it say "unless they are a security guard"?

The Barrister specifically quotes the person should be told by the citizen that they are under arrest.He also says Police Community Support Officers use citizens arrest powers.. as do store detectives...

 

But I expect you will either not reply-or change the subject.

I wouldn't assault someone,personally.

Can you give more detail to your hyperthetical situation?

I don't think where they are is relevant anyway.

Personally,if someone wanted to arrest me,I would call the Police myself,so conceding doesn't even get half way there.

 

Would anyone quietly concede being arrested..well,some do,some don't.What's your point?

That's not news since anyone can do a citizen's arrest.

I am glad you agree,so thats not news to me.(this thread is getting somewhat other-worldly)

heres what i do if i know someone has left the store without paying for items they have concealed i stop them outside the store and ask them to come back into store. i then explain to them what i have seen via cctv and they come clean and give the goods back i then inform them that they are being detained for theft and the police are being called. they then give me there details sometimes they refuse and wont give them until the police arrive. the police then arrive and i tell the police what has happend they then view the evidence cctv etc. and they then place the person under arrest i make a statement put the cctv onto a disc and the police take it from there. thats my job
