Thought there was something wrong.... You know me going into panic mode, :eek::eek::eek: Im going to hand it in to the court this morning now.... whats the next thing that will happen re - court and Finance U??? What can I expect now?? I will also send a copy of the AQ to Finance U.... should they send me a copy of what they have sent back??? thats if they have an AQ sent to them???

you dont have to return a copy of the aq to the claiment, only the court. remember, recorded delievery, if handing in. that will be fine as they will record it.

 

the next step will be if they respond to the aq

when you are in court ask if they have sent it back.

it will cost them i believe now 200 quid for this aq.

 

if they have not returned the aq, we go for strike out.

 

if they do return and every thing is in order there will be a hearing to determine what track the claim be allocated to

 

small claims under five grand

then its fast track over 5 grand

 

once that has been done the judge will allocate a trial date

 

stick at it

 

not long now, it will soon end

Ok Postie that makes it clearer,

 

I will ask at the court today if theyve received it, do we both get the same time limit to return, and also will it be 200 quid per person or per claim??

Then He Will Have To Pay 400 Quid

Hi Postggj, just handed the AQ into the court, The clerk stamped the both AQ s with todays date and said it will be sent to the DJ for directions... I asked whether Finance U have submitted their AQ and was told the court received a letter today asking for an extension ... what do you make of that?? They did issue 2 N1 claim forms so I guess they have to pay 400 squid;)

Will let you know how I get on

Cheeky beggars, they are looking to see what you have said first IMHO.. I personally think this is unfair that the claimants / creditors are given so much leeway.. after all they should have had everything in place before setting out on this path.

Quick one before I go to work...... received today a letter from my local court which says:

 

 

Upon reading a letter from the Claimant.

 

Upon the courts own motion.The Court has made this order of its own initiative without a hearing. If you object to the order, you must make an application to have it set aside, varied or stayed within 7 days of receiving it.

 

IT IS ORDERED THAT

 

1. Unless Claimant files allocation questionaire by 24th August 2009 claim is struck out.

 

Dated 10 August 2009.

 

 

 

 

What do you make of that then???

remember what i told you

 

the claiment needs to spend 200 quid on an allocation questionair

 

in your case 400 as your other half got a claim form

 

now unless by 4 pm on the 24 august the court does not receive the 400 quid

 

YOU WIN

Quite annoying they get extra time though..

. should have their house in order before taking us to court..

 

 

.. I think they were hoping to win by default and us not to defend..

.also heard off a friend that his daughter is a solicitor..

 

 

I suppose she would know the default notice is rubbish and the fact that we didnt receive a termination notice before they took the car... dont you think?????

Just checked with court this morning,

lady there very helpful,

 

 

she explained that the other party also received the same letter as us giving them till the 24th

or the judge will order the claim to be struck out.

.. she also said that they havent returned theirs yet:rolleyes:

Update... I have received a copy of their AQ, I have to go to work now but will post it up later....basically didnt come up with anything new but looks like they are going all the way with this
