In need of help

 

Rceived court papers and Restons are acting on behalf of MBNA. Have requesed a CCA from MBNA back in October last year and still no rec. I verbally asked Restons for it and they sent me basically an SAR with all my staements from the first initial one and Terms and Conditions. On the letter it stated

 

"The leagl agreement has not as yet arrived however our client has informed us that this has been ordered and we will of course forawrd this on under seperate cover in due course".

 

I spoke with a J Rimmer at Restons stating that I still have not recieved a CCA and was told that a CCA is not applicable in my case as it was an Internet Application. Is this true? HELP

Welcome to the CAG.

 

You will be best starting your own thread where you will receive direct help.

 

Also as a matter of policy NEVER ever speak to the lender as, despite these calls may be recorded blah blah blah... they never are if it supports your case. Always work in writing as this will be producible when/if there is litigation.

 

Another important point is when was the account taken out?

Hi amman,

 

I am unsure about the situation with respect to online applications.

 

In my opinion, for what it is worth, if the lender was aware that at some stage in the future documentation will be required to enforce an agreement then they, as the experts in the matter, should have provided it.

 

To my way of thinking a simple CYA.

 

If you do not get more help hit the triangle and ask to make yourown thread - I am concious that this one has been hijacked
