    • Thanks for your reply, I have another 3 weeks before the notice ends. I'm also concerned because the property has detoriated since I've been here due to mould, damp and rusting (which I've never seen in a property before) rusty hinges and other damage to the front door caused by damp and mould, I'm concerned they could try and charge me for damages? As long as you've documented and reported this previously you'll have a right to challenge any costs. There was no inventory when I moved in, I also didn't have to pay a deposit. Do an inventory when you move out as proof of the property's condition as you leave it. I've also been told that if I leave before a possession order is given I would be deemed intentionally homeless, is this true? If you leave, yes. However, Your local council has a legal obligation to ensure you won't be left homeless as soon as you get the notice. As stated before, you don't have to leave when the notice expires if you haven't got somewhere else to go. Just keep paying your rent as normal. Your tenancy doesn't legally end until a possession warrant is executed against you or you leave and hand the keys back. My daughter doesn't live with me, I'd likely have medical priority as I have health issues and I'm on pip etc. Contact the council and make them aware then.      
    • extension? you mean enforcement. after 6yrs its very rare for a judge to allow enforcement. it wont have been sold on, just passed around the various differing trading names the claimant uses.    
    • You believe you have cast iron evidence. However, all they’d have to do to oppose a request for summary judgment is to say “we will be putting forward our own evidence and the evidence from both parties needs to be heard and assessed by a judge” : the bar for summary judgment is set quite high! You believe they don't have evidence but that on its own doesn't mean they wouldn't try! so, its a high risk strategy that leaves you on the hook for their costs if it doesn't work. Let the usual process play out.
    • Ok, I don't necessarily want to re-open my old thread but I've seen a number of such threads with regards to CCJ's and want to ask a fairly general consensus on the subject. My original CCJ is 7 years old now and has had 2/3 owners for the debt over the years since with varying level of contact.  Up to last summer they had attempted a charging order on a shared mortgage I'm named on which I defended that action and tried to negotiate with them to the point they withdrew the charging order application pending negotiations which we never came to an agreement over.  However, after a number of communication I heard nothing back since last Autumn barring an annual generic statement early this year despite multiple messages to them since at the time.  at a loss as to why the sudden loss of response from them. Then something came through from this site at random yesterday whilst out that I can't find now with regards to CCJ's to read over again.  Now here is the thing, I get how CCJ's don't expire as such, but I've been reading through threads and Google since this morning and a little confused.  CCJ's don't expire but can be effectively statute barred after 6 years (when in my case was just before I last heard of the creditor) if they are neither enforced in that time or they apply to the court within the 6 years of issue to extend the CCJ and that after 6 years they can't really without great difficulty or explanation apply for a CCJ extension after of the original CCJ?.  Is this actually correct as I've read various sources on Google and threads that suggest there is something to this?.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

thanks for that, i found some posts pointing out how to find your mortgage in the prospectus, i'll post the links in a sec.

 

How did you find out it was Holmes? I'm just wondering if theres a definite way of finding out the company name to search for at FSA, for the prospectus.

 

I'll have a look at Swift Advances for you when i go back down to the fsa on monday.

 

If anyone else needs to find their prospectus at the FSA please let me know, i live quite close to the fsa & i've got a document scanner, i can scan to pdf, i'm more then happy to help.

Do you or anyone else happen to know the name for GE Money too btw?

 

SmarterChick what date do you need the prospectus for? As in what date was the property charge or title changed at the Land Registry? So i can find the correct prospectus for you.

You can find the details on Santander and Abbey prss releaes on their websites. They don't normally attract consumers to these pages, just investors, but it's there if you read through them.

 

However, having scanned Companies House for some of these companies I note that a number have recently been put into Members Voluntary Liquidation which begs the question of what happens to the securitised portfolios? I listed them here:

I dont think its GE Capital, as GE Capital was sold in february,

 

"On 7th January 2009 GE Capital Bank Limited, which provides GE Money credit cards as well as store finance and auto business, was acquired by Banco Santander SA. As a result GE Capital Bank Limited will be part of the Santander group.

 

GE Money Mortgages & Secured Loans are still managed by GE Money and are not included in the acquisition."

 

 

 

GE Money Mortgages should still have the info.

 

Does anyone know under what name GE Money is listed on the stock exchange as?

 

Or known to the FSA as?, as the FSA fined them quite a few times, but theyre not listed with the FSA ...

ok i think i found it, its listed as "GE Consumer Finance provides a variety of financial services to retailers and consumers in more than 50 countries. Also known as GE Money"

 

Can anyone confirm that is GE Money Mortgages?

They call themselves GE Money Secured Loans Ltd on my agreement and on their court papers they call themselves the same too. But there are loads of companies that GE jiggle around with - these below are listed on companies house - so it's anyones guess isn't it?

From what i remember none of those are listed at the FSA, & i cant find any of them listed on the Irish Stock Exchange, so they all must be going through a single company or a couple of companies.

 

Can anyone shed some light on GE Money? Basically which company is listed on the FSA or the Stock Exchange which represents GE Money's shell companies.

Although WestLB's asset-backed securities are mostly triple-A-rated, demand for them has dried up since last summer's crisis in the credit markets. WestLB is lucky enough to have a state government in North Rhine-Westphalia which in December 07 issued a statement to guarantee that WestLB would be provided with appropriate capital if needed.

 

WestLB, based in Düsseldorf and one of the regional German banks, or Landesbanken, has two major programs, known as Harrier Finance Funding and Kestrel Funding, that borrow money by selling short-term commercial paper to investors. They then invest the proceeds in higher-yielding securities, including ones backed by American mortgages.

A similar principle underlies the so-called SuperSIV — formally known as the Master Liquidity Enhancement Conduit — proposed by Citigroup, the largest sponsor of such vehicles in the world. Together with Bank of America and JPMorgan Chase, Citigroup is proposing that up to $80 billion be devoted to buying up mortgage-backed securities and holding them until the market relaxes.

Its not as far to the top as everyone thinks?

oh just to try and explain what this siv business is

 

The letters S-I-V stand for structured investment vehicle

they are the main cause of this credit crunch, and sup prime mortgage melt down,

An SIV is a type of complex bond as so called low risk way for banks to finance credit cards etc, like all good ideas it snowballed.

to set up sivs banks BORROWED CASH they sold `commercial paper ` its like an IOU in funny money??

Investers buy this fully money or paper at a cheap rate, hoping to sell it back after a short period of time and get their money back without having paid interest.

Banks got greedy and wanted this quick buck and bought the likes of our contracts

but all grades of these loans or credit deal contracts were all threw into baskets. some were ok others no hopers.

so the bubble burst, unfortunatly its us that are paying, even bonus money to these critters

Hi,

I went to the FSA, but couldnt find GE Money Mortgages listed, is it under another name?

 

I had a similar problem with Abbey National PLC, it only had a prospectus for 2006 & nothing onwards.

 

Speaking to the person at the document viewing room, he suggested i try Abbey National Treasury instead.

 

I found some prospectus's, but im not sure if theyre related to National PLC, i'll upload them later.

 

Anyone know what name i should be looking for GE Money Mortgages under to find the prospectus, as i cant find it in the FSA.

 

I found its not as easy as going down to the FSA if you want to find the prospectus for your securitised mortgage.

 

If anyone can help finding the prospectus, or suggest the name to search for GE Money Mortgages at the FSA, or for Abbey National PLC, would be much appreciated.

am glad i have come accros your thread as i am persuing the same

i hope your are still doing the same, just wanted to inquire with you on the following,

i too had the mortgage with abbey from 2006, i found links to some securitization info on their site, but whether it directly relates to my mortgage is unkown AboutSantander | 2006

 

as you suggested in another thread that we should get the 395's

i found on companies house webcheck that they have record filings of all Holmes Financing no 1-9

which all have couple 395's may cost less than £10 to download all of them.i will be getting these asap as am close to companies house

 

am not sure if holmes are the actual trutees

but as tyou state in your other step by step post that the info from the holmes will contain the spv and then we get the 395's of the spv

 

then we check on InvestEgate, Company Announcements for the prospectus (what the a particular search info you have to enter)

 

then we go to 1.1 in the prospectus to find the 395's

 

download all the prospectus of the trustee and spv

up to 6 months + from the date of the mortgage

 

then search the prospectus for the title number of the mortgage

 

do a s425 request (please let me know what that is am not able to find the act under s.425) to see charges listed on 395 at spv premises

 

furthermore use cpr 31.16 to demand disclosure of mortgage transaction number and charges

 

than a good understanding to make a strong case in court

 

i hope this is not exhaustive

 

if you could confirm and correct if neccesary
