This is rampant fraud on every court in America or non-judicial foreclosure fraud where the securitized trusts are filing foreclosures when they never own/hold the mortgage loan at the commencement of the foreclosure.”Charney said, “That means that the loans are clearly in default at the time of any eventual transfer of the ownership of the mortgage loans to the trusts. This means that the loans are being held by the originating lenders after the alleged “sale” to the trust despite what it says per the pooling and servicing agreements and despite what the securities laws require.

“This also means that many securitized trusts don’t really, legally own these bad loans.”

She went on to say, “In my cases, many of the trusts try to argue equitable assignment that predates the filing of the foreclosure, but a securitized trust cannot take an equitable assignment of a mortgage loan. It also means that the securitized trusts own nothing.”

 

 

This seems to be saying the opposite of what we believe to be the case?does it not ........is that why they are;nt registering with the LR OVER HERE.......

Thanks HB It was me who asked whether I could post this so no slapped wrists then - I just wanted people to see the momentum going on over these securitisations over there, the same arguments apply here all be it the different States have different laws and of course, they are different from UK specific laws. However, as you can see, the issues are not lost on the practice and what the legal and financial people see this practice as doing to the economies. Brown cannot get investors to buy our country's debt - that's securitisation gone belly-up for him and it begs the question of who exactly did the Government bail out - the banks or the SPV investors? You may well ask !

I would however really be grateful if Suetonius and Vincenta could put their considerable talents to looking at the points I raised above regarding the whys and wherefores of the Land Registry and the Acts that govern it.

I cannot in all concience post the letter I have until guys of their calibre have done so.

They could be on it. I guess these things take time.

 

Hope that's the case. We need an outcome here. As soon as I'm in the comfort zone with my stuff I'll get on it like a flash. I'll break LR 02 & 03 down. What i'll do is apply the rules of language and punt out as many different interpretations as poss. Time to step firmly in the oppos shoes methinks.

I have sent off for my charges, listed at the Land reg, i should be in receipt of these by middle of next week will keep trying to digest the lr 02 & 03, but really am quite useless in interprating into laymans language im afraid...

 

Has anyone heard how the forensic audit is going ?

Not Yet. PammyG said the end of the month so hopefully we'll hear back from her soon. That QC's opinion and/or the publication she mentioned could be good news for us. Fingers crossed.

I'd forgotten about this. Is the barrister friend up to the call or not? We need to know because if not someone else will just have to do it.

 

I'm all for going pro bono now. This will get taken on because it is massively in the public interest that this gets heard. There's always a few barristers who are anti establishment by temperament and favour the underdog (Mansfield, Pierce etc) and they like to get their teeth into stuff like this. I think it's worth a shout.

 

I know a couple of barristers socially and to be honest they say things are interesting and will look into it but they never do! Time to get serious here, as there's more at stake than just our individual cases. Comments anyone?

Has PammyG delivered? It seemed like a lot to commit to from a relative newbie at the time she mentioned it so not too suprised.
