Yes it wont be any skin off their nose though since they were acting as agents.

Its prob the Law society or Sols regulatory board for them.

So a Letter Before Action is the next step, yes?

 

Yes LBA putting them on notice.

Worth also simultaneously firing a complaint to the ICO.

Reason for that is that a Judge is likely to want to know that you did this-and by the time your claim is issued you may have had a response back from the ICO.

 

County Court Judges have powers to award up to a grand for a breach.

 

Your LBA should invite them to make a reasonable offer of compensation,failing which you will be asking the Court to order full compliance and award compensation and costs at its discretion under the provisions within the DPA.

Unfortunately no.

The only other route is to take it up with the FOS and seek compensation from them.

Will cost you nothing to do that....and although it wont be done overnight-it could be worth a shot.

Its unlikely that they would give any remit to the CCA non compliance-the matters in hand are I think the ways in which they dealt with you under OFT Guidance and possibly the Unfair terms regs 2008.

Yes its a good way to go since you are able to show that in pre action protocols you did give them the chance to address your complaints.

It does not take much working out that the possibility of a grand plus costs could easily border on £1600....But I do suspect that any offer from them would demand Conf and full and final-which is to be expected I suppose.

Theres no temp letters as such Chris because you can do this easily using ICO guidance.

It can be a catch 22 situation if you dont run everything simultaneous for example-a Court will want to know that you have contacted the ICO.the ICO want to know that you have tried to resolve things with the other side etc etc.

In your case you have enough evidence to supply to the ICO given the circumstances-but they are likely to want some written responses from Vertex to you.

In the first instance file the complaint and forward on anything after-the ICO will send an acknowledgement of your complaint and tell you to keep them updated a bit like the FOS do.

Its all about timing really.

Heres what you need to know to get the ball rolling.

Well Vertex have simply not complied with any of my requests for information, including my SAR request. I have a LBA ready to go out, so would that be enoiugh to inform the IC and get the ball rolling, or do I have to write again to Vertex and ask them again for the information before writing to the IC?
