    • If you have not kept the original PCN you can always send an SAR to Excel and they have to send you all the info they have on you within a month. failure to do so can lead to you being able to sue them for their failure.......................................nice irony.
    • Thank you and well done  for posting up all those notices it must have have taken you ages.. The entrance sign is very helpful since the headline states                    FREE PARKING FOR CUSTOMERS ONLY in capitals with not time limit mentioned. Underneath and not in capitals they then give the actual times of parking which would not be possible to read when driving into the car park unless you actually stopped and read them. Very unlikely especially arriving at 5.30 pm with possibly other cars behind. On top of that the Notice goes on to say that the terms and conditions are inside the car park so the entrance sign cannot offer a contract it is merely an offer to treat. Inside the car park the signs are mostly too high up and the font size too small to be able to read much of their signs. DCBL have not shown a single sign that can be read on their SAR. Although as they show photographs which were taken the year after your alleged breach we do not know what the signs were when you were there. For instance the new signs showed the charge was then £100 whereas your PCN was for £85. Who knows, when you were there perhaps the time was for 3 hours. They were asked to produce  planning permission which would have been necessary for the ANPR cameras alone and didn't do so. Nor did they provide a copy of the contract-DCBL  "deeming them disproportionate or not relevant to the substantive issues in the dispute" How arrogant and untruthful is that? The contract and planning permission could be vital to having the claim thrown out. I can find no trace of planning permission for the signs nor the cameras on Tonbridge Council planning portal. and the contract of course is highly relevant since some contracts advise the parking rouges that they cannot take motorists to Court. I understand that Europarks are now running that car park which means that nexus didn't  last long before being thrown out.....................................
    • Hi,   I am not sure if I posted this already here but I don't think I did. I attach a judgement that raises very interesting points IMO. Essentially EVRi did their usual non attendance that we normally see, however the judge (for the first time I've seen in these threads) dismissed the notice and awarded me judgement by default because their notice misses the "confirmation of compliance" paragraph. in and out in 3 minutes (aside from the chat at the end with the judge about his problems with evri) Redacted - evri CPR loss.pdf
    • Just to update this. I did apply to strikeout and they did not attend the hearing. I won by defualt and the hearing lasted 5 minutes (court only allocated 15). The judge simply explained that the only matter he was really considering is if the Defendant could have any oral evidence to defend the claim. However he said he had decided that based on their defence, and their misunderstanding of law, and their non attendence he did not think they had any reasonsable chance so he awarded me SJ + Costs on the claim form + the strikeout fee. Luckily when I sent the defendant the order I woke up the next day to a wire trasnfer for the full sum of the judgement

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone

 

i have recieved the 2nd letter in the threatogram cycle from capquest this morning, from HL Legal.

 

i now am certain they arent fishing and have somehow confirmed my residence, so its time to send the statute barred letter. now do i send this to Capquest AND HL Legal or just one of them? oh and what would happen if i didnt reply at all.

 

also can they then start legal proceedings (or will they) whilst i dispute this debt which is very old.

The 'prove it' letter might be better as an opening shot;

 

Dear

 

 

I Do Not Acknowledge Any Debt to Your Company

 

I am writing in reference to your letter dated xx/xx/xxxx

 

I would ask that no further contact be made concerning this matter unless you can provide evidence as to my liability for the alleged debt in question.

 

If you are unable to provide evidence as to my liability I await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

 

I have duly noted your intention to authorise a collector to visit my home.

OFT rules and regulations clearly state that you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you. There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.).

 

Therefore take note that I revoke license under Common Law for you, or your representatives, to visit me at my property and if you persist in sending “doorstep callers” to my home, you will be reported for harassment and be liable for damages for a tort of trespass. You would also be liable for conspiring in a tort of trespass by acting in defiance of my instructions and sending someone to visit me nevertheless.

 

Should it be necessary, I will obtain an injunction.

right then i sent the prove it letter to capquest last week of Feb, and so far ive had 3 replies.

 

The first acknowledged my complaint letter, and included a copy of the complaints procedure.

 

the second a few days later, stated that my letter had been passed to the relevant dept and outlined the timeline i could expect a reply

 

the third recieved today states that they are making enquiries with the originating company, that the acc is on hold for 28 days in the meantime and if i could supply any documents or proof of payments to the account that may assist with my query would i please forward them ASAP.

 

yeh righto. Anyone smell a stat barred? :grin::lol:

im sure its verging on 6 years.

 

ive had ANOTHER letter today, basically saying the same thing, and informing me they will not pass it to any third party and wont take further action.

right then, ive finally had a response from capquest regarding this egg loan

 

The contents of the enevelope are:

 

a copy of notice of assignment

an account statement sheet (stating last paid in mar 04, bum!)

A signed credit agreement, which is two pages, internet agreement by the looks of things (please dont ask me to scan as i dont have a scanner, but i am happy to describe very fully!)

A stapled together printed off of the web set of terms and conditions which are definately seperate

 

i dont really know what to do with it now, other than i was charged PPI i never needed, and also the balance at close with egg has DOUBLED with capquest.

 

any suggestions welcome!

When you say a signed agreement is it your signature & does it include the prescribed terms which should include; credit limit, repayment terms %APR etc.

 

If you have a digital camera can you take a picture using 'macro-mode' and post it up for us to have a look at?

sorry if these are huge and not in right order? the top paragraph on page 1 states this agreement which incorporates the loan agreement terms and conditions supplied to you with your copy of this agreement contains the terms on and which we provide this loan to you

How 'kosher' is the Statement stating last payment March 04 - it has been know for these to be, eh, incorrect;).

to be honest i thought it was longer ago than that as i would have been 20 then?

You say they advise a payment was made in March 2004. Ask them to provide a statement showing the payment and either a cancelled cheque, Direct Debit acknowledgement, bank paying in slip. It hasnt been unknown for a company to make a payment to an account.

the statement of account shows that that was the last payment before they started to bounce, its from egg themselves, im sure its correct.

hi all

 

 

right after reciving all that bumph i then got a letter stating they were trying to locate the documents, they would be in touch within 28 days, then another stating that, the last one i had saying that was in mid may, now ihave had one offering a payment plan, and now one stating if i dont respond by today (recievedf yesterday) that they would start legal proceedings

 

im not sure what to do? do i need to pay?

if someone could actually help me? after recieving all that bumph i then got further letters stating they were trying to obtain that info from egg

 

the last of which is dated June 13th

 

now ive had two requesting payment, one of which states they are willing to match my payments by 15% and even give me 30 days before paying first payment.

 

next one a feew days later stating clearly litigation is the only way forward.

 

as i have had no responses to my ask for help on this thgread for the last 3 hours i cant sit around waiting so i rang them(number withheld) and did not confirm dob etc i simply notified them i would be sending a letter as they clearly havent sent me what i requested (!)

 

he got snotty with me so i told him to sod off and wait for my letter. now i just need something to send them ?

Following your letter dated June 13th 2009 advising me that you were still in talks with Egg to gain further information regarding this account, i have been patiently awaiting further correspondence in response to my original complaint/query.

 

I am yet to recieve this information and as such your letter dated 6th July advising me that clearly litigation is required as i have failed to pay or contact you is completely ludicrous.

 

One would expect that even the people who are employed by your company are able to file things in date order and therefore see that you have FAILED to provide me with the information i requested and that i have legal right to REQUEST.

 

Please take this letter as a legal request to cease processing my data under section 10 as it is unlawful to do so without a valid agreement, which you appear unable to provide.

 

Frankly, please do not contact me further unless you have something of use to say, i would prefer to save the paper.
