Hi,

After loads of problems with creditors i found this site a few months ago and am in the process of contacting them to claim back my charges etc.. i know late compared to so many people here!

and i found threads on virgin media and successes in getting the charges back.

I have been with virgin media and before telewest since 2001 and because of my work and that i get paid at random times I have been charges most months a late payment charge and non dd fee. which i have all paid because i didn't know otherwise.

I don't have all my statements for all this time. Only have the ones for the last 9 months.

Do i need to send an SAR like the ones for the bank/credit card charges and the £10 fee to get the details of all the charges that were added to my account? or is it a different type of letter? sorry been trying to find one on the site but haven't managed to.

Hi Maylucken, I am doing the same as you, yes send the SAR and a cheque or postal order for £10.

 

I sent it off two weeks ago and recieved it yesterday. Going to claim the late payments and looking into claiming non dd fees. Added it all up and came to just over £600

this is what i have for a bank. do you still call it a banking history or just account history with your company and replace bank/branch with virgin media/telewest?

Please supply me with a complete list of transactions and charges relating to my banking history with your organisation. Alternatively, a complete set of statements for that period will be acceptable.

 

Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my banking business with you.

 

If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.

 

I enclose the statutory maximum fee of £10. You have 40 days in which to comply. Furthermore, if I discover that you have levied disproportionate penalties against me, then I shall be reclaiming them, and also reclaiming the enclosed £10 Data Protection Act subject access request fee.

 

If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. However, please note that the above address is the one which you normally use to communicate my private business to me and which you have hitherto found to be acceptable.

I would be happy to collect the Data from my local branch.

Hi fols im getting lost between threads on here , i have sent off to vm for my statements of charges etc , i expect them in a week or two , when i do get them whats my next step ? I phoned vm last week to complain about another late payment charge , got the usual guff , its quite legal , its in our terms and conditions, other companires do the same , even i have to pay them, oh i dont think you have a chance of reclaiming them . thanks for calling vm . My god they make me so angry.

Hi once you recieve your request add all the charges up and then write them a letter requesting them to be refunded also include a list of the charges.

 

They will proberbly phone you and tell you that you are not entiteld to them and that is there final responce.

 

Once you have had this responce by letter or telephone then send them the LBA.
