Hi All,

I am new here and have requested a number of CCA agreements for my credit cards, American Express were the first to reply.

 

They have sent me the 60 Second Application Form for the American Express Gold Credit Card, the form is signed by me on 29/6/04 but has not been signed by them?

 

Together with the copy of the appllication form are some 17 pages of what look like current terms and conditions, one sheet is headed Credit Card Agreement Regulated by the Consumer Credit Act 1974 however, it is not signed by me and is also blank where it says name of cardmember and address. None of the other pages have signature boxes or details of me on.

 

I would scan these but do not have access to a scanner until the weekend.

 

Any thoughts and advice will be appreciated.

Hi Pilot 62,

 

I have only just seen your thread. More and more people appear to be joining CAG with issues with Amex. I haven't scanned my application form up yet, but it is identical to Elgrands Is this Amex application enforeceable so you may want to compare yours with that.

 

I got the Application with some 'Conditions' photocopied somewhat oddly on the back. If my application form actually had the prescribed terms on the back it appears it was totally unique and prepared especially for me. :rolleyes: I don't think so! - but that is clearly what they were trying to imply.

 

I have just written back asking where these conditions actually appeared. There is also an issue with their interest rates. Pelham is kindly going to have a look at the actual document when I get it scanned up later this week.

 

I suggest you subscribe up to a number of threads so you can see what is happening. Mine is Amex 60-Second Application Form - 2000 If you do a search on Amex you'll find lots more. Yeats, Alphageek, and Monty are all further down the road in that they have court appearances coming up.

 

Amex seem to be the most aggressive of all the card companies. I don't think for one minute that my application form is an enforceable agreement. The prescribed terms were not within "the four corners" of the agreement; they were clearly on a separate sheet which is not allowed, and there is a House of Lords Authority on that.

DD is a great help and there are a lot of others with threads going on about Amex, can I ask if you received the application form with nothing on the back as I have?
