Our home has both my name and my wifes name as joint owners, however my wife died back in July last year (Intestate) and I now have the 'Letters of Administration'. Can I now legally request that her name be withdrawn from the land Registry giving me sole owneship? ...If so how can I do this?

 

Any advice would be much appreciated.

You need to be clear about the phrase 'joint owners'.

 

There are typically two common type of joint ownership of a property, joint tenants and tenants in common.

 

If they were joint tenants, then the property passes to the surviving tenant automatically - LR may have their own forms, but a copy of the death certificate should be enough evidence.

 

If they were tenants in common, then the disposal of the deceased tenant's share is a matter for intestacy law.
