  1. To reply to Bank Fodders question, Yes it is an actual Court Summons which has as to be acknowledged informing of my intentions to either pay-up or defend.

Can someone please advise/assist me in writing a ‘defence’ to a recent county court summons for NOT paying an undertaker his full funeral service fee, for dropping the coffin of a close family member head first vertically into their grave. I have requested a reduction from him regarding the overall cost to take into account the traumatic incident that occurred while he was still in possession of the coffin. We believed his initial ‘good will gesture’ was derisory to say the least, and so he has now sent a county court letter, and I need help/advice constucting a written defence. How do I start? Regards.

  8. Yes....I understand your point and I am uncertain about that myself! I just assumed that as we were married her half of the property becomes mine on death as long as it is registered legally with the land registry which i am in the process of doing at a cost of £40 plus a copy of her death cirtificate.

  10. I still have not got around to changing the ownership from 'Tenents in Common' status I think it is called, to my sole name at the land registry. A 'WILL' was never made, it was one of those things you want to talk about doing but we never did and then she died suddenly without leaving any instructions or indeed and money or valuabbles.

  12. My wife died last summer 'intestate' and left no estate what-so-ever. However she still owed a £4000 unsecured loan to the Halifax. I informed them she had died and sent them a copy of her death certificate, but now they are pressurising me for the money even though my wife was sole signatory to the loan..........Can someone please advise whether I am in fact now responsible for that loan even though I never signed a loan agreement in the fire place? and can they make me sell our marital home in order to pay it off as they keep mentioning 'Bankruptsy'.   14. Our home has both my name and my wifes name as joint owners, however my wife died back in July last year (Intestate) and I now have the 'Letters of Administration'. Can I now legally request that her name be withdrawn from the land Registry giving me sole owneship? ...If so how can I do this? Any advice would be much appreciated. Jendoc

After sending 3 letters demanding the reimbursment of PPi premiums totaling £375, Capital One have agreed to a 'goodwill' refund of £300 though they do not admit any liability and I have to sign a letter to say this is the end of the matter! Can I insist that they pay me via cheque instead of having the refund 'credited' to my Disputed Account? or is that being too cheeky:idea: Jendoc
  17. Hi.....Can someone please direct me to a suitable FOS template letter to initiate my claim for the refund of PPI premiums taken by Barclaycard. I have already sent them the first demand for payment stating 'why' I believe the insurance was mis-sold, for which I recieved a standard reply refusing a refund. Then I sent the LBA but now that deadline has passed and no response! Any advice would be much appreciated. Jendoc

  19. Hi......To answer your query, the offer does NOT include any interest just the £245.00 in excess charges from 2003 to 2006! Do you think I should add on the extra 8% interest before accepting this offer of settlement:confused: Jendoc

Cap One have reluctantly agreed to refund me the excess charges on my card, however I am now reluctant to sign & accept as I am not sure if accepting their offer and closing the complaint will predjudice my PPI claim of £850 that is still on-going! Can I still demand a signed copy of the CCA from them if I have accepted thier refund?   25. Can someone please let me know 'Who' power2contact are? Since I disputed my account with Barclays they sent Mercers, since I disputed the account with Mercers they now send 'Power2Contact' who next?
