    • Now that is an interesting article which adds afew perspective that I hadn't thought significant - but on reflection of the perspectives offered ... Now Starmer is no Blair, however 'blairite he may be perceived, but the Tories aren't tories and aren't even remotely liberal   The fast 'unannounced and unexpected election call from sunack may well be explained by the opinion linked that he hoped reform would be unprepared and effectively call a chunk of Farages largely empty bluster - making him look even more of a prat, leave scope for attacks on shabby reform candidates and mimimise core vote losses to reform - while throwing the 'middle ground' (relative) tories TO THE DOGS - and with the added bonus of likely pacifying his missu' desire to jogg off to sunny cal tout suite somewhat   thumb in the air - I expect about 140ish tory seats, but can hope for under a hundred Reform - got to admit the outside possibility of 1, maybe 2 seats with about 8% of the vote - but unlikely. I think projections of over 10% of the vote for reform is nudged and paid for speculation - but possible with the expected massive drives from Russian, Chinese and far right social media bot and troll prods targeting the gullible.

There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This web site offers a password and letter template for a one of fee of £10...they also offer advice.....

 

you pay the fee ask your question they will reply by email giving oyu the answer adn allegidly the password to allow you access to the template letter area of the site..

 

all you willg et is their advice no password will be given. there is no way of contacting them other than through their 0906 £1 per min telephone line, which is always engaged.....

 

my friends feel they were conned by this site, I have told them to contact trading standards, but cant think of anyone else....

 

please please be careful of this site....

scatz I am only stating what happened in this case.. no password was given...the only way of contacting this comapy is via a 0906 number at £1 a min... unless ofcourse you wish to pay another £10 to ask for a password!

While tomtubby clearly does a fantastic job helping folk for free on this forum, charging £1 per minute for her helpline is scandalous! :D

 

 

Well im afraid she has to earn a living, cant see the government or any businesses coughing up to sponser her. She does a fantastic job and helps many people on here and other sites and never charges a penny.

The website in question we have known about for some time. The site rules prevent us from posting a link. Tomtubby has been here a long time, and does give excellent advice on how to deal with Baliffs, and also check to see if they are ligitimate registered Baliffs and not thugs.

 

As long as TT's website does not contain any misleading items or misrepresentations, does not infringe any other person's rights and does not breach any applicable law, ensure that all information that it provides is accurate, then TT is entitled to earn a living. I would not put TT's site up there with the Debt websites that charge you 25% or more of your winnings, and leave you when the court papers come in.

 

Remember users are responsible for taking appropriate measures against the risks associated with using the internet. Many users have used TT's website and have had great success. I have not heard of any issues regarding TT's website, with regards to being ripped of etc...

 

Most of the information you can find out there on the internet, if you have the 4 or 5 hours trying to put something together, then you will get it for free. TT will probably see this thread and comment later.

Can I please be allowed to comment. If somebody has not received a password then I do apologise, our web designer has assured me that the password is provided automatically after receipt. As a goodwill gesture, the password until midday tomorrow is: france.

 

Concerning the telephone line. Yes, there are salaries to pay, offfice rent , etc, etc and there is no way possible that any company could survive by providing a free service.

 

However, the truth of it is that as EVERYBODY on here knows, I personally am interested in providing assistance and this is why at least HALF of all callers are now provided with an 0871 number that costs them 10p per minute !!! As a company we receive just 3p per minute of this.

 

Every day we receive many calls from local authorities, insolvency practitioners, various police forces and also bailiff's......but these pay the normal phone charge, and I am NOT about to apologise for this...

 

In addition, by February 15th we will no longer be charging £1 per minute and we have instead REDUCED this by round 40%.

 

We do indeed now have a question section where for an one off fee we will provide a full in depth response to any question TOGETHER with full access to our downloadable documents and will will also provide as well a search of our bailiff database. This new service was suggested to us by a poster on another forum who had posted a question and had to read through 15 replies over a period of 3 days to get a response !!! by which time the bailiff had removed their car!! In addition of course, many posters do not want to divulge their problem in public.

 

Finally, I have personally attended many Form 4 Court hearings or assisted in putting together Form 4 Complaints ....and never once charged a penny !!!

When anyone asks a question on this or any other site they take a risk:

 

a) The risk that there isn't anyone available who knows the answer.

 

b) The risk that the person commenting may not know what they are talking about, even though they might sound convincing.

 

c) The risk that no-one will answer the post in time for the info to be helpful.

 

tt offers a shortcut - but like any other person who offers a service she is entitled to charge for it.

 

As for £1 a minute being scandalous, what about the fees solicitors charge? and I'm not talking about legal aid rates.

Unless you are lucky, you don't always get the right advice or information - I know, I've been ripped off by solicitors who pretended to know what they were doing and didn't, and there is nothing you can do about it afterwards except pay them, or face the bailiffs they'll send.

I wondered why your replies seemed delayed.

 

For anyone else who sees this thread....TT personally helped me through a messy time with the bailiffs and with her help I got back ALL OF THE FEES that I was charged. I could not have done this without her help, and for the sake of a few pounds I received spot on advice and tailored letters for me to send to the bailiffs and the LA.

 

She's a STAR :D

Firstly at no point in my comments did I personally attack tomtubby....my comments are and were based on what I know happened....

 

Given the vast numbers of people this site reaches, our main aim was to drawn peoples attention to what happened to one person who registered...

 

Like all things in life, our views are based on our own experience and that is all that was being pointed out....their aim was to make sure that others were aware of what happened..

 

There could be a variety of reasons for why the passowrd was nto present....my friend says possibly she could have missed it..... I showed her what scatz said and she does not recall seeing any password. she printed off the pages showing payment and what have you..... and we have both checked it and found no password....

 

Obviously she was very distressed at the time she contacted them, it could even have been a cyberspace gremlin, the basic point is she did not get the passowrd....there is no email enquiry address that we can see.....only the 0906 telephone number....which she has been trying for quite along period of time...

 

The fact it is constantly engaged shows just how valuable the work that Tomtubby and those who work with her and for her are doing, but look at it from the point of the customer...in their view they did not get the service the signed up for and fouind it impossible to contact the company.... hand on heart who would not feel slightly annoyed ...

 

what other form of redress had they apart from going to trading standards and drawing this to the attention of other equally vulnerable people...

 

They voiced an opinion on their treatment by a company.....not an individual

Tom thank you very much for your response, this was not meant as a personal attack on you, it was just voicing what happened....

 

My friend/neighbour is reading this and she apologises if you feel it was a personal attack, she did not see a password, and has checked what she printed off and cant see it either....

 

what they feel made this situation worse was their inability to contact the company....they tried over a fairly long period... perhaps you can see it from where they are?

 

I myself have read many a post by you and been well impressed, and like loads on this site appreciate the advice and pointers you and others offer, and you do make what at times is a very difficult and stressful time a little less so...

Here is a thread where I received invaluable help from TT.

 

She gave me good advice on the thread, then she asked another member to PM me with her email address. Her reply to my email was to ask for my telephone number, she called me and explained exactly what I needed to do. She gave me a telephone number for the person who could sort my problem out, his reaction, to hearing TT's name, was very impressive. He realised I had received good advice and knew that I was in the right. One week later my problem had been solved, I was even kept up to date on the progress of his investigations.

 

As I've said before, TT you are a star!

I take half a Viagra and drink a cup of hot chocolate every night before I go to bed.

 

The hot chocolate helps me sleep and the Viagra stops me rolling out of bed.

I have used the service and never had a problem, the password was clear to me...alternatively I would have contacted the company using the email address on the nochex invoice.

 

And I havent taken the post personally, why would I?
