Clavering House is 3 miles away from HMRC Benton Park view offices.   Wardrop - unfortunately unsuccessful due to late appeal - assessments opened by HMRC in March 2019. Scammed by Richard Hall (Capital allowances consultants ltd - Clavering House) investments into Cryoblast Limited 15/16 (Paul Huggins - Clavering House) and Eco Cooling solutions 16/17 (Anthony Fitches - Clavering House).    Mccuminsky - scammed by Capital Allowances after providing his details to Stefan Brown Alpha Tax Consultants (Clavering House) payment made to Eco Cooling Solutions.    Robson - scammed by Capital Allowances - 15/16 paid to Cryoblast 16/17 paid to Eco Cooling.    Myself - scammed by Allan Maxwell - MaxTax (other business Maxwell electronics) registered to Clavering House.   Cryoblast Solutions and Fast Tax - Alan O’Hara    Please note there are two Cryoblasts involved - Cryoblast limited (Paul Huggins and Clavering House) and Cryoblast Solutions Limited (Alan O’Hara also director of Fast Tax).    My return simply said “Cryoblast” another thing that should have been clarified as part of HMRC guidelines before paying out the claim.    Cryoblast limited was already suspected to be involved in fraudulent claims before my investment as Huntly had open assessments issued in November 2018.    Cryoblast Solutions, the same company director as Fast Tax where my money was sent was dissolved before my claims were submitted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thanks Sunflower. Have spent the last hour reading through both threads and feel a lot better now, knowing the Scotcall thing is quite routine for Sharkleys. Wasn't so bothered when Mercers threatened to send someone but just got a bit of a fright when it was a different company. Will post off the bemused letter to Scotcall tomorrow and get a letter ready just incase they come to call. Already have my camera at the ready following previous advice so will just sit back and wait for them now.

These DCA companies exist to extract money from you in any and every way they can. But when they say "ring us immediately" or "pay this much now, or else", it's just hot air.

 

They're unlikely to do much and, if they do turn up, follow the advice in the link above - "I'm NOT talking to you. Goodbye" and close the door.

Well, the calls have started! 3 to my landline, 2 of which I did't answer, a text to my mobile and a call to my moblile. Don't know how they got the number as it's pay as you go and I only give the number to family and friends. I didn't realise it was them and answered it. Once I knew who it was I started asking Mr Barcays how the weather was, had he had a nice Christmas etc. He started getting quite annoyed and said he wanted to talk about my account so I said can't possibly do that, it's in dispute and I only deal with finances by letter. He told me I was entitled to my opinion but the calls would continue so I said I would look forward to our daily chats and I did so hope his job was safe! I think he thought I was a bit mad and he hung up. Am keeping a note of the calls. Will look forward to the next one....

Thanks Sunflower - made me chuckle. Rang the swine flu helpline but all I got was crackling.......

 

Mercers calls haven't been as often since I sent Scotcall a letter, only seems to be a couple a day. My daughter thinks its great fun trying to get to the phone before it rings off. She thinks it's people trying to sell me windows. She managed to get to the phone one day and answered 'Dominos pizzas! Do you want pepperoni or chicken with that?' They hung up! lol!

 

Still no agreement from Barclays - won't hold my breath....

Yes it made me chuckle as well!I got another post card this time direct from Mercers saying they going to send me some hunk to visit me in a couple of weeks time! LOL:rolleyes:So i suppose one day i will come home from work and see some strange man lurking in my garden!:eek: As one thing i will say about Barclayshark/Mercers they do not lie about sending real human callers!They actually do send them:eek:i will have to hand Nurse-elsa swine flu poster to them along with no visiters letter!:D
