      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Everybody I hope you are all winning !

My question is probably stupid, but, have been in serious dispute with OC since 2008 got rid of various DCAs over time but latest is ignoring a/c in dispute letters and letter re non compliance with CCA request. Going to send another A/c in serious dispute letter, but what is best route to get rid of them

If you have sent them a previous dispute letter and they are choosing to ignore you, it is simply because they haven't told the threatomatic to stop sending you deforestation, the best thing to do, is to reciprocate their ignorance and do the same, IGNORE.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi

OH had credit card with a bank in her single name prior to our marriage. Lowlife who have come out of the woodwork, have consistently ignored the fact that there is a serious dispute situation. I wrote to their compliance manager as advised on here and my request was completely ignored.and they are still continuing to threaten as follows ;-

Obtain credit Ref report ( they say they have it) on OH

sending A/c to doorstep agent for visit

Apply to Court unless OH makes a minimum payment -No chance !

This is their so called last chance letter

However as disputed debt was never assigned to them - to my knowledge and bank has given up on pursuit what right have they in this situation. Any advice would be great

the bank may have given up but they have probably sold debt unto Lowlife, theres a template that will stop their little threat of doorstep visit. How long since a payment was made? Lowlifes are well known for chasing Statute barred debts

Hi

Account is a credit card which was set up approx 30 years ago when bank was under previous name.Last payment was made 3 years ago. CCA request was made and not complied with as bank could not produce copy of signed agreement, throwing account into serious dispute. Bank eventually stated in writing that there was no point in further contact. Last payment was made 3 years ago.I understand about doorstep visit template, and that is not a problem.replied to Lowlifes letters with copy of serious dispute letter twice, then sent compliance request letter but just being ignored and they are going their own route.How do I stop this?

String the clowns along, there is absolutely zero they can do to you, there is no agreement therefore they will be unable to take any legal action against you, check your credit file and if they have left their dirty paw prints on there take them to court and sue them for defamation.

As we don't have copy statements etc, I cannot even guess at any amounts owed to OH,

but, they probably outweigh most of the alleged debt - which is probably reason bank dropped pursuit.

We are more interested in getting everybody off our backs for obvious reasons

Send it 2nd class post and obtain "Proof of posting" from the PO counter.

 

Send it each and every time they respond, and ignore them, there is absolutely zero they can do.

OH has a C.C.debt which has been in serious dispute for last 4 years.

 

OC a bank cannot produce any paperwork.

 

Been around the houses to everybody inc Lowells who passed onto Scotcall

 

Another letter received from Lowells stating passing debt onto another DCA.

 

My question is what do they hope to acheive in this situation.

 

We have given up letter ping pong 12 months ago and just ignore them- surely a complete waste of time and costs?

Yes a waste of their time, especially as there letters can be ignored.

 

As for cost, well, the way I see it is that, this whole sordid industry is only kept alive by the selling and buying of portfolios of debts, so they might initially outlay 2 million for a portfolio of debts which have a face value of double what they paid, then in that portfolio some debtors will be conned into paying what they either don't owe, because they are unaware of their rights, and the rest will simply be bundled back up and flogged off too the next DCA to buy and have a go at collecting.
