      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Are you sure it was red, sosumi, I remember it as yellow? Surely it was Lifebuoy that was red?

 

I'm obviously older than you as I remember my mother at the copper, along with the dolly (& the dolly blue - recall that one?) & the mangle so if I've got the colour wrong, blame it on the dead brain cells! ;)

I'll bow to your great age then FG ;) Only joking, I'm probably missing more brain cells than you :D

I was thinking anyway, a copper would have been a luxury once.

What a bloody good idea a dolly tub was! And mangles!! Dolly tubs, mangles and soap like housebricks - no electricity required.

It might all come round again. Maybe it has to...

Maybe this is the great leveller - all of this? A dolly tub would be a luxury in many parts of the world, so...

I'd personally feel great satisfaction walking next to the wife of an ex-banker to the nearest stream to wash our clothes...

What would wealth be then? A bar of soap? Water?

Maybe this is when the world gets straightened out.

I have a 'spensive chrome kettle which doesnt work and will be returned to Messers. Argos on the morrow.

 

As back up, I have reinstated the perfectly good plastic kettle, purchased 1987 from Messers. Tesco for £4.99.

You've obviously never had to do a week's family wash with a dolly sosumi - including sheets!! It's sheer exhausting & I'd probably not have lived to my great age if I'd had to do it for the last ermm.. years. :lol:

I'd go into debt in the millions to keep my all singing, all dancing washer!

 

Some aspects of the good ole days are only good to those who haven't lived through 'em....:wink:

By 2014, the bankers will own 68% of all Property, and they'll be looking for passengers to climb aboard the next banking fairy story Balloon trip into the sky. Don't worry that you cannot afford the Ticket, they'll lend you a pile of invisible Number-Money to Buy it.

 

Likewise, if you want to Buy a House, they'll Sell you one they now own, and will lend you an even bigger pile of Number-Money so you can think you are Buying it (although they'll still own it).

"Lions, tigers and bears, oh my!" Where the Rankines are concerned why were they lent such a rediculous amount of money to start with? A computer access from a bank to the credit reference bureaus would show the amount of money they already owed which I thought was the point of this system. Banks can lend responsibly. That bank manager said that if people like the rankines don't pay someone else has too, but who designates responsibility for that course of action? The banks. Now, who does pay the money for all those bonuses for irresponsible lending?

Ummmmm, yes but he neglected to say you have already paid for it anyway.

 

One of the factors affecting interest rate being charged for any particular loan facility is the percentage of customers expected to default on payment. This is arrived at through a number of factors. Risk factor- 1st mortgages are safer than Buy now Pay Later! Expected customer profile, length of loan, longer= more time to default, market experience and yes, they employ actuaries.

 

The expected default level is then built into the price, the limiting factor being what the market will stand.

 

Simply:

 

If default = expected level, the company makes the expected return.

 

If lower default = higher than expected return.

 

If higher default = ooops! Lower than expected return.

 

In the latter case this will filter into higher rates/tighter undewriting terms, which is exactly what is happening.

30-second intro, followed by 'Leanne's battle' - the phone operator's responses (1st Credit) have gone, replaced by BBC text to explain what 1st Credit were saying instead.

No mention of Rankines...

Whole thing is at most 2 minutes, with 1st Credit's response underneath.

That was the BBC News page to promote the main show, which was already on-line when the show was broadcast. It's not really meant to be an edit of the full show, but (being the BBC) you can't call it an advert either...
