    • You need a back up plan. If you believe that redundancy is very likely, start looking at other employment options.  Don't leave it until you have been made redundant before looking for new employment. I regularly speak to people who have been made redundant and about mental health. Those who have a positive plan, get into employment quickly following redundancy and manage to maintain their finances. Those who don't have a plan, decide to accept redundancy and a period of unemployment. They end up in a downward spiral, with redundancy money spent, debts accumulated, mental health decline and difficulty finding new employment.  
    • Interested observer here as I'm in a similar situation. People become conditioned into seeking and maintaining a perfect credit score/file, but if your situation is that you're unlikely to obtain further credit for the foreseeable future anyway due to your other outstanding debts, then tanking your credit file now won't make a difference other than you've took back control of your finances.
    • Firstly, I would like to thank everyone for their help in this matter. Since my last post I have received a reply from Plymouth Council Insurance Team concerning my wife’s accident (please see enclosed letter and photo of the offending Badminton post) which they deny any responsibility for the said accident. I feel that the Council is in breach of their statutory duties under the following acts: The Leisure Centre was negligent in its duty of care and therefore, in breach of the statutory duty owed under section 2 of the Occupiers’ Liability Act 1957. Health and Safety at Work Act 1974 (the Act) to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all their employees, and others who might be affected by its undertaking, e.g. members of the public visiting the Leisure Centre to use the facilities. The Management of Health and Safety at Work Regulations 1999 that requires employers to assess risks (including slip and trip risks) and, where necessary, take action to address them. The Provision and Use of Work Equipment Regulations (PUWER) require the risk to people’s health and safety from equipment that is used at a Leisure Centre be prevented or controlled. I would like some advice to see if my assumptions are correct and my approach to obtaining satisfactory outcome to this matter are accurate.     • Talking to them does not reset the time limit, although they will probably tell you it does, they'd be lying. Dumbdales are the in-house sols for Lowlife, just the next desk along. If Lowlifes were corresponding with you at your current address then Dumbdales know your address. However, knowing that they are lower than a snake's belly, you would be well advised to send them a letter, informing them of your current address and nothing else. Get 'proof of posting' which is free from the PO counter, don't sign it, simply type your name. That way then they have absolutely no excuse for attempting a back door CCJ.   P.S. Best course of action, IGNORE them, until or unless you get a claim form......you won't.
    • A 'signed for' Letter of Claim has been sent today so they have 14 days from tomorrow... Lets wait and see what happens but i suspect judging by their attitude they wont reply

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

OK heres my situation

 

I have a capital one account, and after a huge divorce, and a redundancy things are really bleak this end, however I found you guys.

 

They sent me a letter after countless phone calls telling them of my state, just demanding payment, so I wrote to 30/06/08 them outlining my present circumstances and income level(not a spreadsheet)and was prepared to send as much as i could afford to them as a gesture etc, replied (10/07/08) saying ok sorry but we want paying. They just pressed ahead and sent me a default (06/07/08).So as they waded in with both feet well bo**oc*s. I then sent them a CCA 08/07/08 (replied 22/07/08) and a telephone harassment / formal complaint letter 08/07/08. They have replied to he complaint letter by telling me what i owe them and asking me to ring them!.

 

I have received 22/07/08 a signed application form and some current docs Phaf! These look identical to others on here non enforceable.

 

I have also had a letter outlining the reply to the harassment letter (25/07/08) in which they say ring us and pay up nicely and do not address my complaint! (04/08/08) further complaint reply asking me to pay and ring them. (06/08/08) arrears letter received. (06/08/08) also now a statement of default letter.

 

In between times I have had a nice letter of Debitas (07/08/08) telling me to pay up, and within a few days another telling me (14/08/08) they are going to send someone round to have a chat! and pay up or else.

 

So its more than 12 days since my CCA to CO letter but do I have to wait a further 30 to send them a letter stating that they have a non enforceable contract (and bog off etc) and or a letter stating that they have acted illegally sending my details to debitas and my account is in dispute i.e. cant be passed on and or interest charged etc. Would it be wise to throw a S.A.R - (Subject Access Request) at them and calculate the charges and interest etc?

 

I have sent a CCA to debitas and am sending a harasemnt letter too with the ending stating the doorstep tresspass etc.

 

What was the line to do with DCA re the passing of my paperwork and the account status? "something or something" on the closing line of one of the letters ?

 

I need to get this sorted as I have the same issues for Barclaycard and the Halifax

Debitas are Cap1's inhouse DCA - operating from the same building in Nottingham, so I dont think that the 'account in dispute - you cannot pass this on' actually applies as they havent actually passed it out, just shifted it to another department.

 

You've done well in sending the harrassment letter to Debitas but unfortunately you will get the same rubbish re the CCA from them... send the S.A.R, definitely. Im sure if they have defaulted you there will be illegal charges in there somewhere.

 

Just out of interest, which address did you write to?

300608 -Long running battle,threatening court, CCA letter NO 2 and harrassment letter sent - passed back to Littlewoods early July.

070808 - Passed to Debt Managers, Acct in dispute/BOG OFF letter sent 080808...

140808 - Letter from Debt Managers passing debt back to Littlewoods - RESULT! :D

Hi DerbyDude, i am in exactly the same situation as you, but have made a claim in the court for bank charges. My account has been in dispute since 2007.They still harrass me by calling 3-4 times daily, even though i have called them and explained situation to them, and sent numerous harrassment letters. I am presently seeking advice on how to sue them for harassment.They will not listen to you, so is best to put a claim for bank charges in the court, before they take you to court.

Really would like some more advice on this, also Debitas has a company name listed with companies house, so its a separate company? whether its in the same building or not.

 

I also would like advice as to my partner writing to these companies re communications harassment etc?

Hi there, yes a SARS is the next step, to calculate your charges and interest, then send repayment letter, then Lba letter, and then file a claim if they do not pay up. Debitas is Capital Ones dca, but they will pass the debt onto another dca.I am afraid they wont listen to anything you say, as far as they are concerned you owe them money and thats it. I have been writting to them for over a year, and sent numerous harrassment letters, so i decided to put claim in court, so its gaining interest every day. And they cannot take me to court over this debt as there is a case going on.

OK heres a bit of an update for the records

 

Sent out letter by RDP, for CO not complying to the CCA requested time fully expired 21/08/08 and mentioned that a copy of an application form with the current T&C's wont wash this end! Sent reply outlining such also dispute and non referral to outside agents etc within and closed with "alleged debt letter etc" 7 days further to respond.

 

Also under separate cover RDP, sent a further letter "stronger wording" outling the flagrant disregard of my request dated 30/06/08 re harassment.

 

Debitas - Sent letter of compliant / harassment and have copied same to my MP and TS office I have also informed them to NOT doorstep me.

 

Have diaried forward my 40 days for the S.A.R - (Subject Access Request)......

 

The clock is ticking on the CCA for Debitas ........

I'm in the same position regarding Capital One/Debitas. Have CCA and harassment letter sent recorded (received by them 15/08) but still getting phone calls.

 

I have most of my statements, but will probably have to SAR to get the rest. Hopefully this week. (£10 postal order needs to be saved up for!)

 

I'm logging all of my phone calls to support my claim of harassment.

Good old Debitas sent me more "you will conform" printed rubbish today, so I sent them a letter outlining the following "Office of Fair Trading Guidelines on Debt Collection" with a 7 day clause in it.
