It sounds as if you may get letters from people like DWF solicitors or a company called Retail Loss Prevention but we always recommend to ignore them. If the police weren't called on the day you aren't going to hear from them. Ask us any questions you want to and keep in touch but I don't think this will go anywhere. Best, HB
    • Hello, firstly thank you for reading this. I know no one wants a long winded back story. So I’ll be breif. I entered a local store to buy some paint (which I did pay for) I am honestly not a bad person or a theif.   Didn’t have a basket or trolly as was on my lunch break. Whilst picking up the three tubs of paint placed some masking tape in my pocket (it was hanging out of so I had every intention to pay) just didn’t have a hand free. Paid for my goods (forgot about the £4.39 masking tape) I’ve got so much going on and im not well at all (like I say no one cares I get that) also have autism so wasn’t thinking particularly like others do maybe (who knows my minds going around and around) I left the store after paying, was pulled back in by security. Asked for the tape which I gave immediately  shook up. Gave them my ID and details. I was given some paper and told to expect a large fine in the post for their time and the tape and sent on my way. my questions are: I hardly ever go out without support so the ban I guess I can’t go there now for anything (their loss) - ok but is my photo going to be all over with my name? how much am I expecting in the post as a fine? I have sent them cash in the post recorded signed for delivery to arrive tomorrow (incident happened today) for my error. Their Address was on the bit of paper. i have read two posts on this page but they were from many many years ago so I hoped for updated advise please?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

:confused: have debt for £2700 with robinson way for 3 n half years now, i have paid them every month by standing order of £50 and never missed a payment. they phoned yesterday sayin i can settle the debt now, and save £70 i told them i was not in the postion to pay that amount, so they got funny and said i have topay £100 for the next 3 months or i will have charges added to the account. i said i was happy paying the £50 and will continue to do so till the end, but they said they couldnt accept it and started asking how much i get paid,i refused to tell them anymore personal information and if they wanted to get any more money off me to take me to court. am doing the right thing n can they actually do anything now.(i only have 6 payments of £50 left)

DON'T talk to them on the phone, they will only try to threaten and pressure you. They have no authority to make you pay money that you don't have/cannot afford or to levy unfair charges. If they do put charges on the account, you can dispute them. Send them the telephone harrassment letter - I'm sure someone will be able to provide a link to the template.

I find it rather strange that they would start hassling you for more money now, as you only have 6 payments left. And have paid them for 42 months on time as agreed

Maybe some DCA monkey is trying to get some commission for early settlement

 

If you are happy to pay £50 for the next six months and can afford to do so, I would suggest you ignore their demands and continue as you are doing

 

As for the extra charges tell them to stuff it (in a polite letter of course)

It sounds to me as though Robbers Way are feeling the pinch

 

If it was me I would say I have paid enough so sod your £300

 

No doubt some-one else with expert knowledge will come along soon and help you

So please take their advice over mine

robinson way are phoning me every 3-4 months wanting MORE money,It's called a courtesy call by them, .....and I tell them I'm not paying anymore get stuffed (or words to that effect).....I also have been paying them regularely for the last 2 years and never send them any info or answered the socalled securityquestions....they got my name, adress,phonenumber,....and sending me monthly letters....what more do they need ?????W.M.

.......Thanks Mr. Ton,....it's a waterdebt I'm paying which went to court some years ago but as I was out of the country in that time ( for about 2months) I didnt defend it on the court papers and so it got send to robbersway.....W.M.

Report them to Trading Standards and the OFT for breaching guidlines:

 

Physical/psychological harassment

2.5 Putting pressure on debtors or third parties is considered to be oppressive.

2.6 Examples of unfair practices are as follows:

a. contacting debtors at unreasonable times and at unreasonable intervals

b. pressurising debtors to sell property, to raise funds by further

borrowing or to extend their borrowing

c. using more than one debt collection business at the same time

resulting in repetitive and/or frequent contact by different parties

d. not ensuring that an adequate history of the debt is passed on as

appropriate resulting in repetitive and/or frequent contact by different

parties

e. not informing the debtor when their case has been passed on to a

different debt collector

f. pressurising debtors to pay in full, in unreasonably large instalments,

or to increase payments when they are unable to do so

2.9 Charges should not be levied unfairly.

2.10 Examples of unfair practices are as follows:

a. claiming collection costs from a debtor in the absence of express

contractual or other legal provision

b. misleading debtors into believing they are legally liable to pay

collection charges when this is not the case, for example, when there

is no contractual provision

c. not giving an indication in credit agreements of the amount of any

charges payable on default

d. applying unreasonable charges, for example, charges not based on actual

and necessary costs

e. applying charges which are disproportionate to the main debt.

Request a copy of RW's complaints procedure and make a formal complaint.

thank you for your advice guys!!!! i havent heard anythin from them yet they have took the usual £50 out my bank witch goes to show they cant take more as they said they was going to lol, n courtesy call they could try callin it that if they was actually courtious
