A&L sent a response to my first letter stating that the OFT were refering to credit card payments!!! Is this correct? I have been trying to claim bank charges not credit card charges. They also say that the OFT have not entered into any discussions with the banking industry reguarding current accounts so they therefore cannot accept we have been unfairly charged.

Do I still send them the second letter? They are not mentioning about the ombudsman which is stated in the second letter to be sent.

 

Please help. Im only trying to claim back £720, not a lot to them but loads to me!!

 

Can anyone help me???

I received what sounds like a similar letter this morning.

 

My understanding is that although the OFT talks about credit card charges, they also say that the principle applies to overdrafts on bank accounts etc...

 

I take it you wrote a letter similar to a template on this site? I think that the OFT section is additional to the main argument - although it may add weight.

In reality people were claiming their money back before this announcement was made anyway. The fact remains that the bank's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. So the bank's quibbling about what the OFT said or didn't say is somewhat beside the point.

 

I hope this helps... I think they are trying to scare us. and I'm only requesting repayment of £37.50.

The first letter i sent was not on this website so i have sent the first letter from this one now with it slightly modified. Hopefully this will be a bit better!!

Hi, Lil. Welcome to the forum.

If you haven't already done so, I would suggest you take a long good read around the site, you will see that this is just one letter in a long line of hot air that A&L send out to their 'victims' in the hope they'll be confused or scared off.

 

Have you opened your parachute account yet, as they WILL close your account for making this claim against them. 8)

We all know that charges and letters are sent out automatically,but just as a matter of interest Simon did your respondant even bother to sign yours.

I say this because there is a big blank space on my letter where the author usually signs, it was from a M Parker.

This just goes to show the contempt that they have for us when a reply to a letter you took the time to write is not even signed: anyway who the hell is M Parker at the customer service centre. :mad::mad::mad::mad:

I checked my letter and mine was from an M parker too!! AND not signed!! This is obviously a computer generated letter that gets printed then stuck in an envelope!!

Hi Lil, I just received the exact same letter this morning, unsigned, with M Parker's name on the bottom. So it is definitely a stock response and just trying to put us off the scent. The wording made me hesitate too but if you read the notes at the bottom of the Letter Before Action template it explains that in fact the OFT has stated its ruling applies to all consumer contracts, which includes us and our bank accounts. So we are well within our rights to keep going, mustn't let them scare us off!

Your right!! Im just in the process of setting up a joint account to go with my other account in a different bank incase they close it then i'm gonna sent the LBA letter. So glad of this site, puts my mind at ease!!

They ARE perfectly aware of what they say they dont agree with.........which is the reason for their threats of account closures !!!

 

Pursue your claim using the set procedures laid down in the site.

If you dont have statements then send a full sar disclosure request.

If you have the statements.......send the prelim with a charges summary.

If you already sent the prelim send the lba with summary adding that you are disappointed they dont agree with the oft findings but you are to carry on.

 

Go for it !!

I know, me too, I wouldn't dare do this without the support of the site & forums. Just sent my LBA this week and have opened an account elsewhere. Now waiting for the storm to break! Go for it and good luck.

Got a reply from SJ Osullivan, unsigned again. Actually i got 3 letters all the same!!! They say the same as the first one so just waiting for the 14 days to be up and then am going to the next stage!

Hi,

I sent the first letter from the one of the links given on Martin Lewis' Money Savers' site and have ended up with the identical letter that you guys have.

Can anyone post a link to the letter that gets results? I have been unable to find it.

 

Just another point that makes my blood boil is that a large organisation like this can play so fast and loose with basic human morals...what a bunch of liars!

I've already bailed out and I'm with the Nationwide. I'm after £714.86...not a lot but with two kids at Uni...

I think its just a standard letter they send out to throw people. Alot of people on this forum advise not to get caught up in letters with them. If they do not do as you request then just go to the next stage. The FAQ section is really helpfull. I wish you the best of luck, im claiming for £720 and like you i have two young children so every penny counts!

Hi there is a more even handed letter you could send.

Read alanfromderbys threads in the defaults section.

This has already proved to work for some !!

Hi again!

Ive just received my spread sheet from Vamp (thanks Vamp). I am claiming for a joint account and a sole account in my husbands name. Can i put both of these on the spreadsheet or do i have to separate them. Also when filling in claim form for the court would i have to do this all in my husbands name as one account only has his name on?

I would do a separate sheet for each account. Try phoning your local court or MCOL to find out if you should put both names or just your husbands on the claim.

Thanx caro, i'm gonna put the claim in my husbands name so if it goes to court he can go!!! He's quite happy about all that so to save the bank being able to stall us for silly reasons, then we'll cover every possibillity!!
