Link have been on my back for a while and have finally come up with the following.

 

Could someone confirm or otherwise that this is an enforceable Credit agreement please?

 

It has been signed by them but I erased details.

 

They also included a letter of Assignment with this, I'm not too sure about that either.

After having seen a number of other documents of this type from GE money I believe that they are, overall, enforceable.

The prescribed terms are present in the small print.

 

Time to get a dispute notice into Link and go for the charges from GE.

 

ACCOUNT IN DISPUTE

 

Dear Sir/Madam,

 

Your ref:

 

 

Thank you for your letter of **DATE**, the contents of which are noted.

 

 

I am disputing the total value of these debts with **BANK** due to unlawful and unreasonable charges. As such, therefore, I consider this account to be in dispute and no further action or payment shall be made until this matter is resolved.

As per OFT guidelines Section 2.8k "not ceasing collection activity whilst investigating a reasonably queried or disputed debt."

 

Should you fail to provide me with the required undertaking within 7 days, I shall report your breach of the OFT guidelines to Trading Standards and complain to the Financial Ombudsman Service.

 

Take notice that I will not discuss this matter on the telephone, and all further communication must be in writing. Any further telephone calls will be perceived as harassment, and dealt with accordingly.

 

I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you would prefer to do this than merely respond with standard letters and leaflets.

 

I would appreciate your due diligence in this matter.

 

I look forward to hearing from you in writing.

thank you for the bump mrsc and thank you for reply curlyben.

 

There are some charges on the account but not a great many.

Link Financial have been the last of a long line of dca's hounding me for the paltry sum of 115.00. still, I shall get that letter out tomorrow.

 

If Link now own this debt, do I ask them to refund the small amount of charges? or do I send to ge money?

Waste of time asking a DCA to refund charges.

Go for GE.

Now you have raised the dispute with them they should back off.

If they don't we have ways of making them.

Your letter will go off to Link tomorrow. I will also draw up refund letter to ge money with schedule of charges.
