    • If the purchaser denies having received it then sue P2G. If you simply don't hear anything more from the purchaser then you have the purchaser's name and address – and frankly for £48 I would go ahead and sue. As long as you have good proof of delivery then your chances of success are probably better than 95% and frankly the purchaser would probably put their hands up as they would effectively be being sued for the civil equivalent of theft. I wouldn't let it go if I were you. It would be a good exercise for you and gives you confidence the next time something comes up which is may be much more valuable

Not only did I do the work, but as a maths tutor delivering financial literacy workshops under the Govt Multiply project, the college were paid £400 for each student I recruited, which makes it an even bigger kick in the teeth! I spoke to Citizens Advice Bureau on Friday who advised me to go back to ACAS for advice and assistance, as ACAS are the experts in employment matters. They did also mention small claims court, as being more straightforward and less complex, but surely their solicitor would just contest this and I would lose the £80 court fee? If I did submit a claim through the small claims court, would I just leave the employment tribunal running until the outcome? The deadline for me to submit my schedule of loss is tomorrow, so I will submit today so that they cannot hold me in breach.
    • Ive just checked the tracking again and its actually out for delivery today! Anyway,  I refunded the buyer on Ebay off my own back on the 2nd of June they havent opened a case or anything like that so surely i cant take action against either the buyer or P2G/ Evri can i ? Id hope the buyer would see fit and pay but you know what people are like these days ... Once its delivered I'll send him a polite message asking for payment but i suspect there'll be no reply

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Lissen up peeps...those who attended the inaugural CAG Pasty Meet/Eden Picnic will back me up on this - a five gallon tub of Bookie's so called rice salad appeared...and a five gallon tub of the stuff departed at hometime...

 

And as for the inaugural CAG Mod Meet, the scenario was exactly the same...

 

Pots au chocolat - I would certainly give them a try, but Bookie's rice salad...???...I wouldn't touch it with yours...

Phew, I'm so pleased you're not totally going Bookie :)

I have spent many hours reading your posts (not all 18,000 of them I have to say :D I'm saving the rest for when I retire :eek:) and have been both amazed, totally creased up laughing and almost in tears (but also full of admiration ;)).

 

How you can respond so politely to some of the cr*p you have had thrown at you I will never know :D

 

Anyway, I digress - so back OT, I think I'm off rice salad for a while - will stick to my pasties :lol:

my rice salad is wonderful and very very tasty

 

Actually I have to agree, even though it would be fun to join in and take the mickey like everyone else.

 

Even the weird looking really thick vinaigrette type stuff which went with it was rather yummy.

 

 

I remember you posted the recipe in the old Bear Garden. Alas it has now gone with all those posts. Perhaps it should be reposted for everyone's benefit.

There's always one, isn't there, one who really has to put a fly in the ointment...here we have all and sundry decrying the rice salad (because it is yukky) but you have to say it is nice...and then you ask for the darned recipe!!!

rice salad is nice but only if it has what u like in it. Pt you sound like my other half when u rabbit food. he says anything with the word salad in it is rabbit food.

Ah Barra Barra Barra. I know you have your principles to consider, but if you ate anything but veggie food you would realise that rice salad just doesn't do anything for us confirmed carnivores who are used to the taste of so much more scrumptious goodies.

 

I was served a veggie risotto t'other night which looked remarkably like the offending salad. Best of it was I was on a sodding sheep farm and they had loads of chickens too. What was that all about?:rolleyes:

I have yet to sample the delights(?) of the rice salad. I would like to try it before making judgement. Any chance of an invite (apart from the Liverpool gathering. I would really liked to have met Janet)
