      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Martin, I often come on and read posts without logging in (often when I'm half asleep). I am in Nottingham and I'm not a 'lurker'!!

 

One of the Experian offices in Nottingham - opposite the main one, is a great big place. When I took my SAR request to the Reception in Talbot House (main office) I first went into the wrong place - the one over the road. You walk up a flight of steps to the 'reception' in that one. They had security guards 'guarding' it - struck me as odd at the time. They redirected me - but why does Experian need security guards? Particularly for an office block that isn't advertised? Their main office - the one over the road - didn't have any.

Lets get it straight I'm not against there being a data base to check for fraudulent applications because we all pay for fraud.

 

What I am most certainly against is not being told you have been subject to such a search because if your rejected & you know not why you won't check the Hunter database Therefore any inaccurate data will never be corrected & the longer it remains on file the more credence it will be given.

 

Also if it's intended to combat fraud why keep it a secret? Surely letting the would be fraudsters know they could well be caught by this all encompassing system is a more sensible way to fight these crime.

 

No I think the existence of this 'unpublicized' system is in line with this governments thinking. They want to know everything possible about everybody & what better way than to know all about a citizens financial dealings, data now easily available all in 1 place

I agree with you Jon.

 

I have no problems with the fraud provention but not knowing about it and all the secrecy around it makes it seem very suspicious. I also think it could been a a par of the goverment thinking. They want to bring these new ID cards in that from some reports, Not that i believe them but the goverment have not fully explained the cards, say they will do away with bus tickets and records and in the end you will have this one card which will have everything on it from how much money you have in bank to full medical records. How do we know if this agency is not already helping them do this?

Pity not a resounding result but he did try.

Their interests in other peoples activities, appears to extend to a well executed CCTV system covering their premises.CCTV stills for subject capture ?

At least on that one, SAR full disclosure isnt an issue-of course as far as we know.......:rolleyes:

I'm gonna SAR them. I've never heard of these people and find it disgusting that financial institutions have potentially passed my details onto them.

 

How do we know there aren't any other secret organisations like this that they are checking with? How can my contract with my bank be so vague? I am always hearing about the 3 credit referencing agencies, but not N Hunter Limited.

 

Right, before I fire my letter off and line their pockets even more deeply, can anybody explain to me why they are entitled to a fee of £10 instead of only £2?

CPR is better for gettingfull info a company holds on you. Best of all it's free and they have to comply a lot faster than 40 days. :D

 

It also makes them wonder what you're up to as the template letter implies you're preparing doucments for a court claim.

I think you got the wrong end of the stick.

 

That is very specifically for getting a copy of the original signed credit agreement from original creditors and DCAs.

 

In that situation, you say your case is that you think the CCA is improperly executed and you are intend to apply to the court for a declaration of the rights of the parties. Or you are challenging their right to charge you PPI. Or whatever. And so you demand the agreement under CPR 31.16.

 

With N Hunter it is just a normal SAR - like you send to the normal credit reference agencies.

 

If I fire a CPR 31.16 off to them then they are going to (quite rightly) want to know what court action I am planning to bring against them. If I don't tell them they will ignore my request. If I then file the N244 they will seek costs against my due to unreasonable behaviour.
