have asked a couple of questions on the debt collection agencies thread, so not sure if i should post there ...?

 

here's my question(s)

have sent off numerous CCA requests,

not because i've got loads of creditors but some of them have got couple of DCA's acting for them (in one case 6 for a debt of £30).

 

monday the 10th July is the 12 working days deadline and several of them haven't even acknowledged the letter..

.they did receive them cos they went registered post.

 

HSBC (and Intrum Justitia acting for them) haven't acknowledged the request and another few.

So do I write and remind them? or just wait and bite my nails???

 

well it's saturday night and i'm on this goddam addictive website..

.so i'll give the nails the night off and bite on something else..chocolate, olives....

 

oops! i've digressed again, anyway whatcha think?

.....bit scared, i've read on this forum that Intrum Justitia are nasty and even tho' i've been paying them for ~3 yrs i've always paid on time so i've never experienced this , so a bit apprehensive!!!there'll probably a good bit of hyperventilating going on over here!

I'm dealing with another DCA on something similiar. They acknowledged the letter quite quick but have done nothing since. Here's what I wrote to them - might come in useful to you:

 

I wrote to you on the 3rd June 2006 asking for some relevant information. I enclose a copy of the letter which was sent by recorded delivery.

 

You wrote back to me on the 6th June 2006 without answering any of the questions put to you in the original letter.

 

As 37 days has now passed from the date of my original letter you are now in breach of your duties under section 78 of the Consumer Credit Act. If you do not answer my original questions and reply within seven days I will have no choice but to escalate the matter to the relevant authorities including the Office of Fair Trading and the Information Commissioner's Office.

I have today e mailed my local trading standards regarding non compliance by 2 dcas for cca agreements.

Here is the reply I just got back.

I emailed Consumer Direct once. They tried to call to discuss my issue, but I couldn't take their call. Anyway, they asked for a load of info back - but you can't send them an email or attachments as they refer you back to the web form.

 

Seem to be very quick off the mark otherwise - had a response from someone within a couple of hours.

I just completed the online complaints form.

 

I managed to fill in all the info its just a case of skipping some bits of the form.

I have mentioned that I have been referred there from my local trading standards.

I will keep you posted about the response.

This is an issue that has taken up lots of my time and I am determined to get some sort of result.

While I see that the OFT has a problem dealing with an individual or organisation and will generally only intervene if swamped with complaints.I see the trading standards as having lots of clout to address this.

 

We should actively keep at them to comply.......in the same way when they are chasing the debt they simply will not go away

Forgot to mention In my DPA request letters I have added the following;

If it is your opinion that you have no legal requirement to send me any manually intervened information then you do of course have discretion to send this either now or at a later stage.

 

 

Both Barclays and citi have sent me man int data.
