Let me address your questions and provide a clearer chronology of events: • Purchase Date from Amazon Germany: June 12, 2020 • Item Failure Date: May 2022 • Notification to Amazon within Warranty Period: June 2022 • Return Arrangements to Amazon: The agent from Amazon emailed me the request to send the item back. • Issues with Warranty Period: When I raised the issue of the lost parcel with Amazon, they mentioned being out of the warranty period, even though they had previously initiated the return process. It seems the date had passed, but that wasn’t the case. I initiated the return within the warranty period (before June 12, 2022), but the return hadn’t generated a label (it needed to be sent abroad). So, I contacted Amazon, and they instructed me about the process on June 26—handling everything myself and the cost to be reimbursed later. • Choice of Interparcel: Interparcel was one of the few couriers/brokers that would ship the item to Slovakia. • Involvement of parcel2go: I used "The Evri International" service, which is operated by Parcel2go.com Limited (company number 02591405) under the Evri brand. This led me to decide to go after them. I realize the importance of answering the questions and apologize for any oversight. Here are the additional details and clarifications: • Witness Statement and Court Bundle: I haven't prepared these, as I wasn’t aware they were needed. • Mediation: I did attend mediation; however, Parcel2go rejected all my claims. I understand the gravity of possibly having to abandon the current case and pursue Interparcel or Evri directly. Your advice is invaluable, and I will provide any further information required to help assess the situation and determine the best course of action. Thank you again for your assistance.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi I need some help and advice. I browsed a website regarding childrens sats tests and to register i had to leave my home no. of course a few days later i received a call saying they have a special offer no obligation pack that I can have a look at and if its not for me I can send it back, all i had to do was pay a £9 deposit, which i did paying with my bank card. A few days later i never received any goods so i called the no. and all i got was a recorded message saying they were closed, when they shouldn't have been so i decided to email them. I received an auto generated reply saying they would be in touch within 2-3 days. Another few days pass and still nothing, i find another no. on there website and try this only to listen to awful music for 25mins so i decided to send 4 more emails (kind of peed off by now) i get the same reply and still nothing. So it was to my great shock that when I was checking my bank balance this evening I see they have taken a further £80 out of my account!!!!! I immediately call the bank, they cancel my card and start a fraud investigation. This has now taken me over my overdraft and will get a lovely £30 charge tomorrow. I have since checked out this website and they seeml egit but i just read there terms and conditions which states that if they don't receive there goods back within 7 days they automatically charge you full costs , the lovely sales lady omitted to tell me that one. Am I liable for this even though I have never received there goods, not signed for anthying and even paid a deposit???? please help i can't afford to lose this money.

First of all, Welcome to the Consumer Action Group :)

 

There are two things I can think of you can do to start with.

 

1st. Contact Companies House and see if they are a Reg. Company and if they have a registered address you can write to

 

Companies House

 

2nd. Check their website again and see if their website is 'Hosted' If you contact the host company, they may pass on your complaint to their client, it has work for me once before.

Hi

I have had dealings with this company.

I received my disks, but when I tried to cancel no-body answered or the telephone message said offices now closed when they advertises opening times 10-4.

 

Subsequently I was charged but managed to reclaim the money from my credit card.

 

I also reported to TS and they were aware of this company/[problem].
