HI

 

I need real help please, I lived with ex partner for 4 years and in that time he got numerous loans all in his name, totalling to 48,000. We were not married. He could not repay the re-payments and went into an IVA though I had to sign as i had a next cataglogue. So I signed the IVA forms as well. We have since split up and he is not paying the IVA now and I have been told that I either have to sell my home (i have a 15yr old son) or go bankrupt. I am a nursing student due to qualify in december 08. I do not know what to do, can anyone help me please.

Hi we too are going through an IVA at the moment but even though it is for a joint IVA we have our own debts, none in joint names, so we both have a separate file numbers and both have to pay different amounts each month. Sorry I can't give any constructive advice as I am new here and getting to know this really helpful site. I am positive there are others who can give you the advice you need. It would be worthwhile to have a look at the IVA, see if there are separate file numbers or contact the trustees from the IVA see if they can advise

you need to contact the insolvency practitioner.When the iva was set up ,you employed them to act on your behalf .when was the iva set up? how much was paid into the iva?ask them to send you a detailed account.. how much has been paid in? who have they paid & how much. Before you can do anything you need this info.I'm sorry but I'm sure you already know this but you should never have entered into this agreement.I am only too well aware this ,the iva option seems an easy one to resolve debts.....but from my own experience the insolvency practioner is only helpfull when you are paying them.once you stop they'll ditch you.Don't let them.

in my case when the iva failed the practioner contacted the creditors.if your debt was only to next.the practitioner will contact each creditor informing them the iva has failed.Its now up to them to take you to court,if your indebtedness is ONLY with next.then contact next explain what has happened & try to resolve the matter with them directly.if you didn't have credit agreements with the other creditors [included in the iva] I don't think they can enforce the debt if it goes to court.
