I posted my first letter on 7th July asking for my £3000 back and haven't heard anything... I did threaten with Legal action if hadn't heard in 14 days so will wait until Monday to see if recieve anything... I'll write and give them another 14 days to respond before filing on Money Claim?

Ok so my first letter was posted on 7th July and no reply so going to send out my LBA and give them another 14 days before applying on Money Claim...

Getting closer to a lot of money and looking forward to it... £3500..... included of 8% interest.... I know people who have got this back without going to court... I'll keep you posted... Has anyone won recently? How long has it took?

I posted my letter on the 6th July and today they offered me £1995 of the £3400 I was claiming which included interest... I will be pursuing the rest... thats good it was the first letter back.... no messin...

Ok the 14 days are up since sending my LBA... time for Money Claim... can anyone help?

Which address do I input for the HSBC address? someone said 8 Canada Square or someting? can I just use the Leeds address?

 

How long does it take to get the money through from MCOL?

I've read it's usually 5 days for acknowledgement, then they say going to defend... then once they say they will pay up which is usually 7 days after the 5... it takes 5 days from accepting to actual payment... 17 days.... approx

In the particulars, do I add:-

 

Claimant has account (A/C No) with Defendant from (Date)conducted on their standard terms and conditions. Claimant is claiming the return of £ taken by Defendant in charges over 6 years. The Defendant's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. They are also invalid under the Unfair Contracts Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999.Para.8 and sch.2.1.e.

In the event that the charges are not a penalty they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. Defendant has declined justification of charges despite repeated requests. Claimant claims interest under Sec.69 of the County Courts Act 1984 at a rate of 8% a year from(Date) to (Date) of (£0.00) and also interest at same rate up to the date of judgment or earlier payment at a daily rate of (£0.00).

Angela1606 posted a helpfull thread with regards to charges. I think the £30 applies to claims up to £300. £50 for claims up to £500, £80 for claims up to £100 and £120 for claims up to £5000.

 

I had to pay £120 as mine was almost 4k

I filed with mcol on 3rd August and I received a partial offer on 5th August which I declined. I reckon they must have sent this before they realised I had started a claim. They then acknowledged the claim on the 8th August and I received a full offer on the 10th.

 

Still waiting for the money tho!
