Now maybe you read this differently from me but from my perspective, if full payment cannot be obtained the Court expects the debt to be secured against the goods in order for a payment plan to be offered.

 

As you say in that thread,

 

The HMCS contract also clearly shows the Courts expect the levy of goods before a payment plan is considered. If the payment plan is not adhered to, the bailiffs are then expected to remove the goods.

 

 

So maybe you can post this up for us all to see..

I telephoned them explaining, and later she rang me back and said they have made an appointment for me to go to court on monday to put my case foward and in the meantime if the bailiffs come back to tell them this and they have to wait for the outcome

hello,

I saw the bailiffs today I was driving home and he was on my front so I just drove past, but then I changed my mind and went back to tell him to do one lol , I told him that the case has been transfered to my local magistrates and that I have to go and show them my income and expenditure, So the bailiff said "oh you will end up paying £10 a week or summat" so with that he went, Can I ask the court to have the bailif charges removed?

So fingers crossed Ill be okay

Dont offer anymore than you can realistically afford.

 

But leaving EMPTY HANDED, is my idea of a good bailiff.

 

 

Can I ask the court to have the bailif charges removed?

Of course it isn't and neither is accepting part payments but that hasn't stopped you pointing out countless times that Marstons/Drakes bailiffs are breaking their contract with HMCS by refusing to accept PP's while not mentioning the flip side.

I dont wish to argue but of course you are aware of the main clause in the contacts with Drakes (Marston's, Philips and Swift that provide that ONLY certificated bailiff's can enforce these Magistrate Court Warrants.

It would be another poke in the eye for the "enemy" as you submitted your County Court form to a Magistrates Court, and they had the decency to phone you back with an appointment..

 

Not such a "useless" form after all then..

Advice from a bailiff? Pay the man!!

 

I went to court today, they were really nice with me and they asked me how much I could afford a month, so I told them £20, and they replied by saying £15 would be quite adequate, and the bailiff fees where wiped off,

So McKenna, I gotta say thanks for giving me the strength to fight back, And as for your advice Put it in your pipe and smoke it!

Very pleasing result, shows that the bailiffs aren't always as powerful as they like to make out.

 

I found this site as I was harrassed by a bailiff who didn't have any paperwork and wanted to strip my flat bare' which would have been theft as I don't own the furniture!

 

Well done for finding the strength to go to court, its not as daunting as it appears sometimes.

TV Licensing fines are issued my the MAGISTRATES COURT, not the County Court as you said in your opening post. As such, the form tony suggested you file at the Court is useless and won't get you anywhere I'm afraid.

 

Thanks Tony, that useless form wasnt so useless after all was it , It stopped me paying bailiff fees of £220
