Without boring you with the details, it is precisely the most ridiculous cases that end up being lost - because the Cagger knows the other party's case is rubbish so doesn't do the necessary work on their own case. G24 are well aware of double dipping.  They have either done it deliberately or else have cameras which can't handle multiple visits to the car park which G24 happily leave malfunctioning so the £££££ keep rolling in. Sadly most people aren't like you.  I've just read various reviews for the Retail Park on TripAdvisor and Parkopedia.  Virtually all of them are complaining about these unfair charges for daring to spend time & money shopping in a shopping centre.  Yet no-one is refusing to pay.  They moan but think they have been fined and cough up. G24 are unlikely to do court, but it's not impossible with two tickets. Try to get evidence that you were elsewhere at these times. Often retail parks will intervene, but I've Googled & Googled and cannot find an e-mail address for the place.  Could the manager of one of your favourite shops give you a contact e-mail address for the company that run the retail park? Right at the moment I'm supposed to be teaching someone who runs two shops at the local shopping centre, but I'm not as he has had to go to a meeting with the company that runs the shopping centre, so I know for a fact that these business relationships exist!!!
    • Afternoon DX, The files were in date order. How would I put them into an acceptable format? I'm not that pc literate.  
    • I think you need to tell us what actually happened. Your original post gives the impression that you were taken to court for a speeding offence. But you go on to say that you received no paperwork. So you could not have been summonsed for a speeding offence because the police had no evidence that you (or anybody else) was driving (and it seems you were not anyway). You were probably summonsed (or more likely received a Single Justice Procedure Notice) for "failing to provide the driver's details." You would not normally be banned for this offence if you were convicted - it carries six points. So did you have any earlier points which meant you were liable to a "totting up" ban?  If you were originally convicted (as it seems you might have been) how was that conviction set aside? Did you perform a Statutory Declaration? There is simply too much missing for any meaningful help to be given. It seems as if there may have been an error by the DVLA but before you consider suing those idiots until the cows come home, you need to explain exactly what has happened.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

well i have received a big info pack from the court stateing that the trial date for my case is 29th march 2007........although i requested that march was a no go as my baby due march 22nd...however they want me to send all case notes to the court and the defendant by the 17th january 2007...........HELP!!!!!!!!!!!!!!!!

 

WHAT DO I SEND.. THEY ALSO WANT TO KNOW ON WHAT GROUNDS IM CLAIMING THIS MONEY BACK...

 

IS ANYONE ELSE AT THIS STAGE IM NEARLY 8 MONTHS PREGNANT AND SEVERLY STRESSEDOUT AND SCARED THAT IM OUTTA MY DEPTH..

each party shall deliver to every party and to the court office copies of all documenrts including skeleton arguements on which he intends to rely on at the hearing.

the copies shall be delivered no later than 4pm 17/3/07

originals to be brought to the trial

all signed statements setting out the evidence.

the court must be informed if the case is to be settled by agreement before the stated trial

You need everything from the http://www.consumeractiongroup.co.uk/forum/bank-templates-library/33060-basic-court-bundle.html + all your correspondence, your schedule, statements, etc.

 

There is a statement of evidence in my sig which you can use. That sort of takes care of the skeleton arguement as well I'd have thought - can't see how you'd need both.

 

You need 3 copies of everything (yes, its alot of paper!). Send a bundle to the solicitors, one to the court and keep one for yourself, including the original documents.

 

I think you could write to the court and ask for an ajournment if you needed to - especially as you already indicated on your AQ the dates you would'nt be availible.

GaryH has just about covered everything. One thing he forgot to mention was that this is all pretty std stuff, nothing out of the ordinary, so you really, and I mean REALLY, have nothing to worry about:D

 

However, seeing as though you have stated on your AQ that March is no good, I'd give the court a quick courtesy call and simply remind them. Could be a matter of a simple misunderstanding. This way you could have the court date put back, giving you more time to get to grips with all the paper work. You'll be happy to know I'm just an inch behind you, Cobbetts have just sent me a copy of their AQ. So I'll have a mountain of paper work to be getting on with myself!!!

Pls, pls try not to worry yourself too much, it is unchartered terrritory, but you are sooooo close, it is only this final hurdle and you are on a winning straight, trust me!!!! You not only have me fighting your corner,you have 1000s more experienced members of this forum too. That should be comforting enough.

Reply soon, you are starting to freak me out. I'm beginning to wonder should I be worrying more than I am?!!

If you dont mind, which county do you live in, if it's close enough I'd be more than happy to buddy you (especially as you are about to pop so soon!!!)

i live cambridgeshire , well im now plowing through the paperwork , i had a cry on ma friends shoulder the other day and she works in an office so she said if i put together all ma work shell copy it all for me and give it the once over , no im not gonna ring court i want this outta of the way asap , god this will prob send me in early labour , im not frightened of the paperwork im frightened to death that ill have to go to court.

muggins73 you soooo make me laugh:D , well i just totted it all up and its over the 4k mark now , ive decided if i get my money b4 i have the baby im gonna have a brand new coach built silver cross:cool: . so thats my motivation now as i wouldnt afford it otherwise.

ive lost half the **** that snotty face cobbett has sent me and what money claim online sent so annoyed at mo and ransacking my flat.

natwest sent me a letter today asking for me to return my bank cards and cheque books as there closing my bank account:eek: so now gotta try and get up another bank monday am and open another bank account just incase stinking letter i wrote dont work.....anyways muggins dont you ever sleep:p

Hi Jodie,

 

As the others have already said, its highly unlikely that you'll have to go to court. Just look at the statistics - 1000's of claims brought against the banks this year, and not one of them defended in court. Believe me, they are more scared of court than you are!

 

If you are worried about the possibility of court, there is a 'buddy' system which you can sign up for. Theres a link at the top of the screen I think.

 

As for a new bank account, the co-op cashminder account is quite good.

I've been reading your thread, and I really admire you.

I gave birth last year and know how stressful it can be, without taking a bank to court!!!

 

I am currently waiting for the bank to send my 6 years worth of statements.

 

I can't believe there're shutting your account down!! They're more than happy to take out money and get us into debt but when we retaliate they do that!! Where's the justice!!

It's made me seriously consider setting up a 'back-up' account in case they do the same to me!!

 

Good luck chick, just think of all the money you'll have to spoil the new arrival, maybe consider treating your-self to a nice massage when it's all over!!

That's a great motivation tactic, them silver cross prams cost as much as a small car, so you go girl!!!!

Don't worry about Natwest closing your account,I opted to open new ones with the Abbey (basically all the banks are as bad as eachother when it comes down to it!) when I started this process just incase. The only reason they haven't closed my account is 'cause I owe them a small fortune:cool:

Answer to the sleep question is not much since having three kids under 5!!!! I find it is midnight before I get a chance to sit down and have a cup of tea in peace, as it is, I'm typing with 7 month old on my lap, dribbling all over my top. Sexy, hey!!!!! The perils of motherhood, hey;)

im just in the process of putting in a new kitchen aswell , i dont know what is more stressfull -running around after my 1 yr old or chaseing bloody tradesmen..........

kinda gettin there with the paperwork side of it , so does anyone know the next step after i send that lot into court and snot face cobbetts.???

I have been to county court before and it is very informal and above all not a criminal court. - Even though Natwest are criminal in their method of making money at £38 per rejected item one of the most expensive I think.

It's good to be prepared, get a majority of your bundle ready, but at this stage DO NOT attempt to print out vast amounts of paperwork.

Remember though, that your bundle needs to be submitted to the court and Cobbett's by the 17th of January.

good good good , well halifax basic account was recommended to me so just applied online and was declined , so now what do i do , i really need a bank account to receive my money??????????????

Co-op cashminder is probably the best (along with Natwest step but thats probably not an option:D). You won't get refused unless you've got a fraud conviction and you get a debit card, plus they've got a decent ethical policy. On the downside though, it takes a week or so to get it up and running, the application has to be sent to the head office.

yep applied there , i have a step account aswell with natwest but they said they are closeing both accounts although my step is in credit????

can they do that?

I apologise as I forgot that the part where the court has requested that all paperwork had to be submitted by 17th January, was meerly concentrating on the actual court date being a little while yet, and trying to calm the situation down.
