I have just received a letter thing where you tear off the perforated edges from this lot of trash saying that they have written to me but not received a response. It is true, they have written to me and I have chosen to ignore them as the debt is years old and in my married name (I have gone back to my maiden name 7 years ago) and I am sure it is statute barred. It is no longer on my credit file which is now clean. However, this new letter states that if they fail to receive a response to their communications, they will have no other alternative but to pass the account to their field collectors who will call within the next 7 days.

 

I will be sending them the CCA letter immediately, but I am not sure what to do if they do not comply within the time frame of 12 + 2 days (is this working days?). Do I have to give them another month on top of this to allow for them to go back to their "client" (Phoenix Recoveries)? Should I say, also, that I think it is statute barred? I am loathed to phone them as I know, from reading other threads, they are very unpleasant and threatening, but I am worried that someone will turn up on my doorstep and become even more confrontational.

 

Any advice would be more than welcome.

I only found this brilliant forum a couple of weeks ago but I have learnt very quickly that you should NEVER phone these people. Don't do ANYTHING right now...someone with more knowledge will be along to support you soon. Honestly, it's almost like you find this forum and your guardian angel appears.

Ok if you are positive that you have not contacted or made ANY payments in the last 6 years then it is statute barred.

 

Don't bother with the CCA if it is past the 6 years. Just write a short but sweet letter.

 

Dear Sir/Madam

I am in receipt of your letter date xx/xx/xxxx. I am fully aware as you are that this debt is statute barred. I require you to close this account immediatley and cease all communication.

 

Failure to comply will lead to legal action being taken against you for harassement under the Protection Of Harassement Act. You claim that you will be sending an agent to my home. This obviousy will not happen, you do NOT have my permission to visit my home, should you do so I will be quite happy to use my legal powers and force this person off my property and I will also call the police as it will be a tort of tresspass.

 

I hope I have made myself VERY clear on this matter and I do NOT expect to hear from you again

Send by recorded delivery, if it a PO Box addy, look on very bottom of letter fir their registered orfice address. and wait to see what happens next.

 

As to home visit, SHOULD this happen tell who ever to bugger off and point out that you have the legal right to use minimum force to remove person from property

as PossVox says NEVER phone them if you are not sure how to handle them, DCA's are very intimidating over the phone, us more experienced Cagges love calls from DCA's just so we can wind them up :lol:

I forgot there is a statute barred letter template, click link and find letter M and send that instead, it gives relevant laws/acts.
