Hi all, have been reading through the Marlin threads as I am now one of the gang:rolleyes:.

Can I just double check that they have to have a ccj before they can get a charging order? (sorry the brain is a bit fugged up).

Will have to go through the HSBC/phoenix paper work to work out my next move, also a couple of things that were said on the phone dont seem right:o

Hi all, have been reading through the Marlin threads as I am now one of the gang:rolleyes:.

Can I just double check that they have to have a ccj before they can get a charging order? (sorry the brain is a bit fugged up). Yes, normally, they would need to take you through the courts to obtain a judgement, then if the CCJ was defaulted on, they could enforce it by using other methods including a charging order or bailiffs etc.

Will have to go through the HSBC/phoenix paper work to work out my next move, also a couple of things that were said on the phone dont seem right:o

These "people" tend to use threats of CO's and Bailiffs arbitrarilly - as if it is they who have the authority to issue them NOW!!! rather than have to go through a drawn out process in the county courts.

I have been through this before with 1st credit, but they still manage to throw me with their dogmatic methods:rolleyes:.

I feel a complaint coming on, if only to get something in writing, as Marlin are refusing (sorry, should that say, not company policy/legally obliged) to confirm any of the conversation in writing even though notes were made.

I look forward to their next communication, which I have requested only be in writing, we shall see:p

I have received a rubbish income/expenditure form, which they call a Questionnair(e).

Can I warn you all, that when they ask if you have a building society account and then the sort code and account number, you do NOT give a dca that information:eek: .

Needless to say I shall be sending my own, (from CAB) to show that I am doing all I can to come to an agreement, and theirs will be going with my letter of complaint to TS etc, copy of course to them:p

Getting a bit confused with this, as the account number Marlin quote is for my current (closed) account, but the amounts are for my loan, and they keep referring to it as my loan account.

HSBC keep responding to my sar request by saying my complaint re charges etc etc.

Effectively this account (current) is in dispute re charges and also non compliance of sar (I did write to Phoenix and tell them).

tell em that this account is for a bank accout that was closed on XX/XX/XXXX

 

HSBC keep responding to my S.A.R - (Subject Access Request) request by saying my complaint re charges etc etc.

Effectively this account (current) is in dispute re charges and also non compliance of S.A.R - (Subject Access Request) (I did write to Phoenix and tell them). put ya foot down and force them to comply to sar, just like i MADE barclays comply with my sar, lol and it cost them £60 for not playing by the rules :D

I cca'd HSBC re the loan, and they sent the agreement, looks exactly the same as my copy:D

I need the sar from HSBC to see what they have done with the accounts, as I don't know if what they are saying I owe is correct.

I need to concentrate on the sar, and go from there, letter to Marlins re dispute typing now;)

They have done the same with me....Metropolition Collections the in house DCA for HSBC/FD appear to have bulk sold a lot of accounts.

 

They have two of mine but I have the accounts statements to show that one was .76 credit for 2 years before I closed it in 2006 and the other was also cleared in 2006 with a zero balance, I wrote to to HSBC asking them to outline the status of the accounts.

 

They were both closed in June 2006 with zero balances yet sold in Oct 2007 with debts....and the funny thing is that one was a savings account with no overdraft facility...

 

Marlin are writing me silly letters and adding their fantacy interest at a miilion percent APR.......I can wait for these jokers to take me to court and I am actually going to pay their office/cowshed a visit next month when I am in their area.

 

and I multimaped the postcode and looked at the aerial photo, I think I'd better take my wellies when I visit..

remus i'd be inclined to say no, reason: they will ONLY give the info they have on you, i.e letters to you calls list (yes i'm dreaming) and thats about it, BUT going by B3rty HSBC just seem to pass all info on and let the DCA out,

catch 22, if you got a tenner to blow then go for it, other wise no

HSBC are pretty good, I wrote saying I was trying to get my records in order could they confirm the details of 2 old accounts, quoted the numbers and asked for and requested copies of the accounts with my 2 X £10 and answers to the following

 

The date opened

The type of account

the overdraft limit

The date closed

the status as closure

 

They replied within a week with all the answers...copies of accounts and sent my 2X £10 back saying they didnt charge for this

 

I haven't advised Marlin yet as I dont want to alert them/HSBC to the fact that its an error, I want them to take me to court as I feel thats the time to get it dealt with.

fair game to your last comment, were both accounts in your name? i know they sent the 2x10 back but if in your name a SAR means EVERTHING not just 1 account you have with them.

I have had problems with Marlin, they went quiet for a while and now have reared their ugly heads despite being paid via a DMP. I have CCA'd them today on all our accounts. They did tell my hubby before xmas that they would accept the payments for 3 months and then get a Charging Order on our house. They are now telling me to ring them extremely urgently, but wont do so.

 

Hubby asked them to put it all in writing last week and they said why and would send someone round, still ringing. They are bullies and always seem to bring out the worst in us and we end up shouting at them.

 

Going to send the no call letter tomorrow and see what happens then, bet they ignore. We have got new phones and changing back to BT on the 7th, so will have caller display, which will make things easier, can leave my phone on the hook and just answer who we want

Just a question, what did your dmp people say about them going for a charging order?

Good luck with your cca's, and I wish I had caller display:)

And complain to TS etc, even if they can't do anything about individual cases, they will take notice if we all complain:)

Hi mrmarmite, well, the letter I received says exactly that;)

 

"We have confirmed with Land Registry that you are a registered owner and as such we are considering instructing Solicitors to apply for a Judgement to be entered against you in respect of your failure to pay the above debt"
