    • sorry but that letter needs to be much much better. you need to express that it was a stilly youthful mistake trying to be the big man and jumping the turnstile to look big infront of your peers. TfL prosecutors are on the email address on their first letter. get the court form sent back to the court , (but copy it first) stating you plead guilty and wish to attend to address the judge in person face to face to show your genuine remorse for your stupid youthful exuberance.      
    • I thought I should send the begging letter to the prosecutor. Does the hearing means the time I need to send back by? I hope that I could teach the lovely students again, which may not be allowed with a criminal record. I would please ask that you would please provide me a single opportunity to settle all outstanding sums owed outside of court without the need for legal proceedings which would have a determinantal impact on my teaching career.  I sincerely apologise again for my crime.     • Utter Rubbish!! lowell dont write and beg for deals once they start court. as for your attitude, we'll thats nothing new for you.😎 you wont be quizzed, it's not like TV, simply refer to your defence/WS when answering anything the judge may ever ask. well it involves chickens. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all, I too, am the lucky recipient of a stupid Lowell letter chasing a Statute Barred debt from '99 timeframe. Since that time ('99), I have no communication with the creditor what so ever. So clearly six years has passed. To the best of my knowledge, there is no CCJ.

 

My question is very simple, do I just ignore the letters in the hope they will eventually go away? Or, send the Statute Barred letter thereby confirming I am who they think I am? Will the latter course of action just result in more letters and harassment? Or to put it another way, which approach will cause me less grief?

Send them the letter, at the very least it will show that you know better than they do and hopefully get them to leave you alone. ensure you inform tham that you will not be making payment now or at any other time.

 

Once you have told them this, they are obliged to go forth and venture

Do as Spamheed says. This will not stop the idiots from sending you stupid letters but if they continue to chase for a Statute Barred Debt then they are in clear breach of OFT regulations and a complaint should be made to both the OFT and Trading Standards.

I got another 2 letters today telling me how disapointed they were that i wasn't being responsible enough to pay them and they're now passing it to their "specialist recovery unit" ( i take it i can now expect letters from Hamptons!!!) who will decide the best corse of action?

They've ignored the SB letter so i guess my next move is to complaint to OFT right?

Exactly the same here, got the same letter today. Going to post in my own thread shortly. It's probably of little consolation to you but it's good to know that I'm not the only one being harrassed unduly by these cowboys.

An official complaint to Lowells, one to TS (copied to Leeds TS as well) and one to the OFT. When you get Lowells pathetic response to your complaint then you can report them to the FOS which will cost them £400.

Thanks for the advice folks. I read someone in another thread suggesting it is best to ignore them period. The rationale being the plonkers at Lowell would not be a 100% sure they have the right person. Further, they would look pretty silly if they tried to take recovery action in the full knowledge the debt was statute barred?

 

However, I think I will fire off the SB letter on Monday and await further drivel from them. By the way, yesterday I received a letter from Red, usual nonsense.

Hi everyone, quick update... I have printed off the Statute Barred letter, however, am waiting for some further advice before sending. I have a kind of dogmatic instinct in me that says 'ignore them', after all, there is nothing they can do other than waste money on letters and phone calls which I will ignore. Having said that, I probably will send it, in due course, just want to make them wait a bit! :p

 

A couple of other points....

 

1. Has anyone ever tried contacting Mr Lowell (AKA James Cornell) directly to ask him to explain his company's many [Edit] activities? I assume so, I'm just curious as to what he said!

 

2. Ditto Lowell's venture capital backers who are funding this [Edit] crusade against many innocent people.

 

3. I wonder what sort of lavish salary Mr J. Cornell takes home? And by the way, his home address is easily found at Companies House, should you wish to personally write and ask that is. You may have other questions too?!

 

4. I belive company directors are ultimately responsible for ensuring their enterprise operates withing the governing law? If this is found not to be the case, they can be both held legally responsible, and disqualified from being a director.

By sending the SB letter you are confirming your identity and whereabouts.

 

Be sure there are no other sticks that they, or any other DCA can beat you with before you send it.

 

Ignoring them doesn't do any harm, especially if you are 100% sure it's statute barred.

 

Why do anything at all that might be helpful to them??
