  2. Hi peeps was wondering if someone could help me with a bit of advice for a friend. Very briefly:- Had a credit card with cap 1 for some year's but has fallen behind with payments due to retirement and ill health. Offerered them reduced payments of £20(still more than they could afford and i don't known what the exact amount is apart from it's over £1000 less than £1500)per month. Cap 1 continually harrassing them for more while aggreed to the £20. Haven't taken any of this off the total owed although i'm told they have stopped the interest. The person in question has told me that they have no recollection of signing an agreement as the application was all done on line and the part that really bothers me, they have been paying PPI and on everything else this stopped at 65 where Cap1 continued to take it for a good 18 months after and when tackeled on the subject did stop but just said there was nothing they could do except stop taking it now, what money they had taken in the past there was nothing they could do about! It's now been sent to a DCA( not sure wich one). Would appriciate any advice on this, i have told them about the site but they're a bit of a tecnophobe:)!

They must be recycling alot of these at the moment- i got a letter from them offering a reduced settlement for a debt that they tried to collect on 4 years ago, it was statute barred then so it's still the same now!! I'm guessing they're relying on me either having no memory(to be fair it did take me a couple of day's to work it out), or they're hoping i've come into money- either way their out of luck!

  5. Thanks for that! I was holding off cos i thought that if they said they'd passed it back there'd be nothing to report really, but now:D! I think i may have been a little generous thinking that they might actually keep track of these things!!!
  6. I've been racking my brains as to what this debt was and then it hit me! Mac Hall have tried to get payment on this debt before (4 years ago) and were told then it was statute barred! It seems thats it's now gone round in circles and hit them again via Cabot:? Then I jumped in before i got advice- as is my way- and atempted to reinstate payment but was stopped before i actually paid anything. I know that any attemps wouldn't have altered the fact that it was barred then and i have, once again sent the Statute barred letter now! What i want to know is does this alter anything in the action i take? PS You'll be pleased to know i've learned better since then!!!!!

  9. Hi Chaps, have been on here before and you were so much help i'm back:D!!!!! Had a letter from Mac Hall this morning (acting on behalf of Cabot) very kindly offering me a reduced settlement on a debt that if it is mine i have heard nothing of for at least 15 years!!!!!! I know this would be statute barred so would simply ignoring them be the best way forward? Ta
  10. Have Just put in complaints with OFT and Leed TS via e-mail on this lot and am about to compose a nice offical complain letter to send to Lowells(thanks ODC for saying thats the way to go).

I got another 2 letters today telling me how disapointed they were that i wasn't being responsible enough to pay them and they're now passing it to their "specialist recovery unit" ( i take it i can now expect letters from Hamptons!!!) who will decide the best corse of action? They've ignored the SB letter so i guess my next move is to complaint to OFT right?

  14. It's amazingly scary to think about how many people who don't have access to, or know about, site's like these and are paying up because they don't know their right's. I have to admit i would have been one had i not have found this site BUT what is even more frightening is how they have the nerve to act as though they are above the law. They assume they have the right person even if they don't, they tell what could be potentially anyone what the debt is -eventually, they ignore statute barred letters and cca's, the list is endless. I will admit that when i first got the letters i was terrified but as time go's on i get more and more angry, this is 11/12 year's old (and in the passed week i have read about cc debt's bought in december that are far older than that!) and as i have been told, the time frames are there there for a reason that is fair to both parties. Some of the people that this lot are targetting will be far more vulnerable than i, or many of the other people that have contributed to these threads are and will give them money that can ill afford whether they owe it or not because of the horrendous tactics employed and if i can contribute just a little bit to making this company's life more difficult, bring it on!!!!!
  15. 5 in three weeks for me- they seem to be following a time frame so i'm expecting another one tomorrow!!! Count me in.
  16. Have just sent the satute barred letter-recorded delivery-and plan to totally ignore anything else (cos the way my lucks going at the moment there will be more!!!) save putting in a neat pile to sent copies to OFT and Leeds TS.
  17. I was also given this advice but was warned that if you choose this route they are a bit slow on the uptake and it will last for about 6/7 months!

  19. Same thing has happened to me for a 11/12 year old card at a previous address. The advice i have been given by many now (and thanks so much) is -don't contact them!- wait until they give you proof that the debt is yours!
  20. As you may have realise from reading these boards Lowells have been v.busy boy's of late. I've only found this board today and already i've learned that 1)it's up to them to prove the debt not you, 2) don't pay anything till you have that proof and 3) under no circumstances ring them get everything in writing. Apart from all that if it were a real debt it would be statue barred by now, there is a template letter on here for that and i'm sure someone with a lot more knowledge than me will point you in the right direction for it. Don't worry about it! This morning i was literally shaking i was so worried but after finding here i feel much better.
  21. They are really busy it seems!! I, and many others it seems, have the same situation. The advice i was given was statute barred letter or leave and see what they do next? Hope that helps
  22. I've had 3 so far and have all been filed in the bin but any that come from now will be kept!!!!
