Has Anyone won against Halifax ?

I have skimmed through the Halifax section of this forum, reading people's posts ie - "First Letter Sent"

 

but I dont see anyone saying "Woo Yay I got my money back"

 

I am on a very limited income (benifits) and am very very tempted to go through with this to deal with Halifax, as I am driven mad by £39 chanrges when a cheque bounces (even though it is my own fault) I dont mind being charged, it is the amount they are charging me thats a weeks income!

 

But I dont see anyone posting to say they have got money back from Halifax, and although i would be willing to take it every step of the way, i am a little concerned about Halifax driving it as far as they can and not being in a position to afford it.

 

So has anyone beaten Halifax ?

The Halifax will be just the same as any of the other banks.

Go through the steps and see what happens.

 

Don't judge the lack of visible repsonses so far as any particular guide.

Don't forget that this forum has only been going for 2 months so far.

If you look through Litigation in Progress you will see that 1 case has been settled in full, and another is in progress. Action has only really started to build up since Stephen's spectacular and well reported case. It is a long process as the banks are in no hurry to pay out and most have to be pushed to the door of the courtroom before settling. Some will even go through the door and you must be prepared for that.

The law, in its majestic equality, forbids the rich as well as the poor to sleep under bridges, to beg in the streets, and to steal bread.

Ok,

 

I paid £100 CASH into the machine at the Halifax at 7pm on friday night into my partners acount to cover the comming month.

The following wednesday 2 DD's were bounced, lack of funds, as the CASH paid in at their machine had not made it to the account ?

 

Charges then came in £39 for each bounce on the DD's (£79)

Charge from credit card for non payment (total £40) - Card was with Aqua

part of BOS or is that Halifax bank of Scotland.

 

Went to the local branch and complained.

Offer of refund for 39

Never turned up

 

Wrote with STD letter - letter back saying (not in our policy to pay back)

Issued papers via moneyclaim online

Halifax paid after court replied halifax had filed a defence.

 

as for the credit card.

 

read above paragraph and substitue Aqua for halifax.

 

Halifax (BOS)- Paid £109

Aqua (BOS) - Paid out £70

 

Halifax do like to take it to the limit, I had booked days of work in both

of the above to go to court and face them, but they took my fun away....

I noticed in the Litigation section it gives the case number, is there any way to look up the info on this online, so when I go and see my Bank Manager I can say to him "Do I really need to take it this far"

 

?

Don't think so. County court cases aren't listed or recorded in this way.

Both cases are now listed in the litigation section, under sweeney (v) halifax.

 

On a side note on friday we recieved a letter which in summary said because we had sued them if we incur anymore charges they will close the account on us withing 30 days.

So if there are no more charges, the account stays open?

 

This is what I am most worried about, as I have an awful credit history and am finding it very hard to open a new bank account :?

Well open an acocunt elsewhere anyway. if you don't use it for a year other than have a bit of money in and out, after a year or so they will probably upgrade it.

Join the club - but on the bright side you should have no difficulty opening a BASIC bank account elsewhere. That's what we had to do, and we moved to HSBC - their basic account lets us do everything online (if needed) and we can pay DDs, SOs, one off payments to any account etc. They only issue a card for cash withdrawals, but if you need a solo / switch etc then other BASIC bank accounts do have these.
