    • Hello, welcome to CAG. Thank you for the information. To answer your question, we don't recommend appealing at all. It will be a waste of your time and you could end up outing the driver. Ask any questions that you have but basically you keep an eye on this, keep the correspondence and if MET ever they send a Letter Before Claim/Action.     • Hi All, Can ii get advice on this PCN received at the services near stansted airport. Picked someone up at night and went to grab coffee and snack in mc Ds, and didnt realise there was zones in this car park, it was late dark and pouring with rain so obvious u see the large 60mins parking free and dont stand around reading everything.     • If you are confident that citizens advice are going to give you the help you need, then you should stick with them. No point in trying to ride two horses at the same time. It will only lead to confusion and conflicting advice. Also, the people at citizens advice get paid. Everybody on this forum works completely free of charge – no payment – no strings.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

It was about them demanding money from britiannia customers that had paid there bill.

 

There was even one guy that had proof he has paid his bill and they did not accept it from him till watchdog got involved.

Their attitude is the same as all the debt collecting industry - we're right, you're wrong, now pay up. They just don't understand there is a possibility they may be wrong and that the only way round it is to say sorry. Should it not be time that all debt collectors get told to sort thmselves out or face having to pay out compensation to the people they make false accusations against. That'll spoil a few Christmas parties!

That is a good idea and would be on that i can see happening as they would never admit they are wrong. I cant see pll actually getting the compensation either as all DCA will just take it off the bill then sunndenly charges would creep on and the compensation would not be existent.

Long before companies go into administration, staff get disheartened and records are not updated correctly. In comes the DCA and without checking facts (trusts a computer printout no doubt) issues letters to all and sundry. Some will unwittingly pay twice, some do owe and others are sure of their facts and tackle the DCA head on.

ok so if this is rite why did IJ not comment on this when they were given the opertunity and why had one customer been told that the matter was now being investigated on the wednesday?

Just had alook at credit Today forum ..makes for good reading and just thought i would share this little gem from the data and CRAs thread

 

I guess it would depend on how the deed of assignment was worded Steve. Mind you, some of these assignments have been pretty dodgy anyway. If I owned a debt purchasing company, I'd be a little miffed at some of the nonsense that finds its way into the portfolios. Totally unenforcable debts, statute barred debts, debts made up of unlawful credit card charges. The list goes on.

Well we all no what its like with a lot of these companys. Wanting money without considering the facts.

 

I would say tho the only dealing i have had with IJ was not to bad. When l told them the account was in dispute they sent me a large pre paid envelope so l could sen all the details off. They have not contacted me since and that will be 2 years in January.
