hi all need help, and i think im in the wrong thread :confused: but seem to be missing some bits of the page strange.

anyway back to problem im having with link finace i recieved a phone call out the blue from this company saying i owe them some money for a window which i had fitted in 1994.from saint helens glass

 

story goes like this i did have the window fitted and from saint helens glass in 2002, i got in to difficulty paying for this as i lost my job

my account was passed to those lovely people at intrum justia.

 

i then had no option but to sell my house as i was very close to losing it.

so i got in touch with all my creditors including intrim justia and asked them for a full and finale settlment which was £995. then my house sale fell through, and had to wait another six weeks for it to sell, so again phoned intim justitia and with some haggling they excepted £800 in full settlement last thing i heard of them...

 

we move swiftly on to 2007 when i recieve a phone call from very nice people from link finance who say to me i owe them money now:roll: for

the same windows. i phoned intrim justia and asked them what they were

playing at and they tried to give me some rubbish about i should have paid

the £995

 

i did have proof but all i have now is a bank statement which shows the payment made to intrim justia of £800 pounds in 2002.

link have gone from saying that i i owe them £395 to £841 in one afternoon strange that.

 

ok action so far by me, is i went to cab who told me to fight it all way

cab also said have they showed me proof of debt they havent

so thats basicaly it i keep getting phone calls, and i keep asking them for proof i that i owe them anythink which i dont

For starters, NEVER talk to these people on the phone as they will say anything to secure payment.

 

Try this on for size.

 

Dear Sir/Madam

 

You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

 

I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

 

I am/we are familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

 

I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

 

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

 

I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.

 

I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

 

I/we look forward to your reply.

Hi mark,

 

I too am having fun and games with Link Financial.

 

I posted my details in wrong area but got a response which contained the above letter which i have doctored to my needs and printed off.

 

Sick and tired of being bullied by these companies.

 

Even if we lose, at least we make it difficult for them.

hi curlyben and setmefree hope you remeber me, i sent the template letter which you were kind enough to give to me to link

 

since then i have had two letter back one basically demanding payment or they will go to court (please do) and another one this morning .

 

 

it reads

 

we write further to your recent correspondance the contents which are noted

 

to enable us to elimante you from our enquires,in the event that this is a simple case of mistaken identiy we requie 6 sample signitures from you.3 must be off official documention .IE driveing licence or bank /store card

 

and also please confirm your address in 1994

 

we look forward to hearing from you within 14 days

 

of course i wont give them anythink but some advice would be much appriciated ps also the amount has changed again from £841 to 364 very odd!!

If there is even the slightest doubt as to your identity, then they shouldn't be contacting you in the first place.

 

Obviously, you're not able to send them anything with your signature on it, or anything else come to that.

 

They have to prove that you are the correct person and that you owe the debt

Throw this at them, along with a copy of the original letter you sent.

 

Formal Complaint

 

Dear Sir/Madam,

 

thank you for your letter of xx/xx/xx, the contents of which are noted.

 

With reference to my previous letters,I wish to draw you attention to your company's lack of compliance with my reasonable request. I enclose a copy for your perusal and ease of reference.

 

Your continued pursuit of the alleged debt in this manner contravenes the OFT collection guidelines, namely;

Deceptive and/or unfair methods

2.8b sending demands for payment to an individual when it is uncertain that

they are the debtor in question,

AND

2.8j requiring an individual to supply information to prove they are not the

debtor in question, for example, driving licences, passports, full name,

date of birth, signatures.

 

As you clearly cannot prove that this alleged debt in anyway relates to me, I wish to register a formal complaint about your company's business practices.

 

I require a copy of your internal complaints procedure within 14 days and I reserve the right to escalate this matter to the appropriate regulatory authorities as I see fit.

 

I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you would prefer to do this than merely respond with standard letters and leaflets.

 

You have 14 days from receiving this letter to contact me with your intentions to resolve this matter which is now a formal complaint.

 

I would appreciate your due diligence in this matter.

 

I await your rapid response.

One letter with a threat of court,and the other helping with enquire's,would they like you also to send them a spade to dig an even bigger hole for themselves.

As for requesting ID samples,send them a urine sample as they are obviously taking the p _ss.lol

Just follow Curlyben's advice, you will soon av their butt holes twitching like a starfish gasping for air .:D

i have had a reply to the letter it goes like this

 

i write further to your recent request for a copy of our internal complaint procedure. please find enclosed a summary internal complaint handling procedure and complaint form.

 

completed complaints forms should be sent to aaddress as at top of this letter and marked for attention of complaints manager name .....so that it may be actioned immediatly

 

in closeing ,whilst i do note your concerns and refernce to 2.8j of the guidelines,we had performed the oppropriate searches and had satisfied ourselves that you were the oppropiate my name ....our veritable belief is only called into question as a result of your allegation to the contary.it is not inappropriate for a person to substantiate their own allegations.

 

that aside we are prepared to enter into the sincere diaglouge that you refer to, and we would invite you to do the same. realistically we cannot commence such dialogue untill you confirm that you are,or alternativey are not our customer. i can confirm that any information that you do provide me with will be treated in the stictest confindence,and if you require the return of papers you submit then this is perfectly acceptable

 

if you wish to discuss matter futher please fell free to contact me on........ we look forward to hearing from you ......bet you do

 

thats from a litigation spcialist so its signed

 

they have sent me a copy of there complaint procedure, and it asks me to for my signature twice i wonder why lol also the name has changed to asset link same company many thanks again for any help

hi me again just thought of somthink else, in all these letters they have sent me they have not provided me with one bit of proof of any debt, how can these companys get away with this?

 

also im going to be moving house soon is it best not to tell them? let them try and find me . i figure that will take them a little while and may cause them a bit of hassle seems like a plan to me

they may be able to help with them hassleing me.

 

To be truthful i dont think they will do a lot seems like they have no bite.

so me thinks i will send letters off and wait for next move of those wonderful lovely helpfull people of asset link.....

I suggest you find out the name of your local county councillor and send the copy letters etc to the TS via the councillor. Knowing that one of their political masters is interested sometimes moves a lazy TS department to act like one of the good ones.

hi there again i have emailed councillor with details, im now putting together a letter to tradeing standards iand im not very good at this so here is what i have done so far what do you think?

Dear sir/ madam

I am writing to you concerning a debt collection agency which is chasing me for money which they say I owe the money is not the dispute but there legal right to demand payment as they haven’t proved anything..IE shown me proof of any debt even through I have constantly asked for it .

They have harassed me on the phone and with threatening letters which I have attached for your perusal. these phone calls and threatening letters are affecting my disabled wifes health as she worrys constantly about them .

I would also like to mention that I have been in contact with my local councillor ......name whom has taken a interest in my case I have sent a copy of all letters to her aswell

what do you think? many thanks mark

update just spoke to a very nice person from tradeing standards who agrees with everthing curlben has said. she wants all information, also i think i forgot to mention how asset link got my current address this i told her and she said that is real real wrong, how they did it was they spoke to my wife and pretened to be royal mail said we have a parcel to deliver, do we deliver to old address five year old address or current address

 

well my wife aint very well and she gave this address, and the phone calls and letters started........:D cheers mark
