  1. Oh My GOD!!! I cannot believe the balls of this company. I recently got a notice from them saying they were pursuing a debt i have with Lloyds TSB regarding a credit card i had with them. The balance stands at £1977 and they need the debt settling in full a.s.a.p. i explained that the account is in dispute as the majority of the balance is made up of unlawful penalty charges and PPI payments from PPI which i never requested. They are not interested and said if i was refusing to make the payment they would begin "proceedings" to recover the debt. I asked the chap to clarify how and if it would be through the courts which i welcomed and he told me "we don't have to tell you how but it doesn't have to be recovered through the courts" This outraged me as i took it as a threat. He then said if i had any dispute then i should take it up with Lloyds, other than that they want payment in full. When i asked again for clarity on his statement he said he was terminating the call. I phoned back and spoke to Mr Gallagher who said he was the manager and he proceeded to give me a lecture on the law about making a CCA request and that it is basically a delaying tactic. I told him i had never recieved Notice of Assignment and he said Lloyds were not legally obliged to supply this as they had not bought the debt, they were just acting on behalf of Lloyds. I finally got fed up and told him i would be making the request to Allied International. He then began to SHOUT at me!!! Telling me i was in breach of the agreement and why am i avoiding payment. I quietly told him i was ending the call and that i will be sending a letter to the OFT regarding the call and the abuse. This company is by far the worst i have dealt with, and i have dealt with a few. They seem to be nothing more than corporate heavies who, if they could get away with it would come around with baseball bats demanding money!!! Anyone else had any dealings with these "sharks"
  2. I actually laughed out loud when i read this!! Are they really that stupid??? They are happy to send you letters demanding money but the minute you make a request they want proof of who you are?? What they mean to say is: "We need proof of your signature so we can scan it into our computer and fraudulently impose it on a document so we can implement it to you and therefor justify our snake like tactics" Keep up the good fight brother!!
  3. No, do not make another request. As long as you sent the request by recorded delivery and can prove you sent it, if they haven't responded then they are just digging a hole for themselves. You have made the request in good faith and they have plenty of time to respond. If they do not reply within 12 days + 1 (i think) then have defaulted on the allotted time allowed. If it passes 30 days and still no response, then they have broken the law and you have grounds to go to the OFT and Ombudsman. The ball is in their court now. Do not speak to them or write to them until the deadline passes. VULTURES!!!

Haven't done an inc + exp budget yet but will get one done for them to see The thing is i am out of work at the moment so we are living on one wage and we have made a true offer of what we can afford. I suppose if we make this abundantly clear to them if they do decide to go to court it will like at least we tried to sort it out with them. cheers for the advice everyone Dave
  6. Recently had dealings with these as my wife is faltering on her Amex card. They phoned her and spoke briefly to explain they are collecting on behalf of Amex and as soon as they upset her i took over the conversation. I asked them if they had deed of assignment but they said they hadn't bought the debt, it was still owed to amex. Can this happen? how can they chase a debt which they dont own?? They were also aggresive on the phone and even though we made an offer of payment they rejected immediately and said the account needs clearing now or very soon. I explained the way things get done and then she said i was being obstructive. After a bit of research i found out they don't charge these companies as they work on a no collection no fee basis, but on a letter sent to my wife they have charged her £400 collection fee. Is this legal?? I need a bit of help with them as they fight quite dirty Cheers Oh, i have made the usual requests etc credit agreement and so on which they have (surprisingly) supplied very rapidly
  7. This is interesting... I have BLS chasing me for a llods tsb credit card. But nearly half of the debt was payments for PPI which i never signed up for. I wrote to them asking for the credit agreement form and also for the PPI form signed by me... Nothing!! They sent another letter chasing payment, so i wrote back... Nothing. Got the final letter today stating if i do not make payment or respond within 14 days they will begin legal proceedings against me. So i phoned... I spoke to a young lad who confirmed they had received my requests, i explained that by law they are obliged to provide the info but he was very arrogant. When i explained that over £600 was PPI that i never took out and nearly £500 was charges, he offered to take £600 off the debt if i paid today. But this isn't the point, i pointed out i hade made a request that they are legally obliged to provide to me, if they can't the debt is unenforcable. It seemed like a cop out so i declined and said the time limit has run its course and i look forward to seeing them in court. I may be stubborn but it annoyed me, he was basically admitting the PPI cover was crap
  8. Hello, Bare with it... Trust me, i sent my cca request in november 07. Since then they have been sending me payment request after payment request... But no credit agreement.... This is funny... On saturday morning i collected my post and the first letter was.... A payment request signed by Chris somebody or other (head of something at cabot) In the envelope next, I found a letter from cabot stating they have been unable to get the requested information from the original lender and therefor will no longer attempt to collect on this account, signed by the same bloke!!! Re-arrange these words:- elbow, don't, bottom, their, from, know, their... This is Cabot. Don't worry about it, it will come!!!
  9. It was done as a personal loan. I thought it was HP but it wasn't... But the car is out of the equation as i had an accident in it (and had no insurance) It was written off. My stupid fault but i can't even redeem any money back on the vehicle...
  10. Hello, very worried now... 4 years ago i took out a loan for a car. Things were ok for 3 years but then i got into trouble. I lost my job and defaulted on the payments. I did manage to get back on track with them but in the last 3/4 months i have been struggling to make any sort of payment. I have phoned them and explained an they have been helpful once, by allowing me one months grace but expecting the payments to go back to normal. I did explain i wouldn't be able to do this as the payments are too high for my outgoings to afford. After numerous phonecalls and letters i got home from work today and a nice claim form from my local court was there to greet me. They are asking for the whole £5k to be paid at once which i haven't got a prayer of doing. I have filled in the form accepting the debt (it is mine, they responded to my cca request with a signed credit agreement etc) and i don't want to run from the debt anyway. I have listed my outgoings on a sheet showing that i can only realistically pay £50 per month (and that is stretching it) I haven't sent the form back yet as i thought i would get some advice from this lovely site. I already have a CCJ and a charging order on my home for another creditor so will my offer be accepted?? The co by the way is Black Horse Thanks for listening Dave
  11. Good call... thanks Also, i have had a thought, bear with me. If i had a debt that totalled, with all interest added of £32k (the original loan with northern rock was £18k, repayments etc £32k) This debt was bought by Link (god only knows how much for, prob about £1000 or something) If my wife and i released the equity in our house, (she has told me we have about £10k in there) if i made an offer of about £4k for the debt to be settled what do you think my chances are? I won't take the answer as gospel, just what your thoughts are... Dave

  13. Don't understand that bit... All my debt is unsecured in just my name. But like i said Link have a charging order on the property. I know that they can only take some of my portion of the equity. So if we sold the house and got £10k profit (for example) they would only have access to my share.
  14. About 30p.... No, we re-mortgaged in 2005.. Complicated but i will try to explain.. House is worth (last valuation) £120000 We re-mortgaged for (i think) £79000 as joint owners (it was previously my other halfs on her own) The council also owns a 30% stake as the low cost housing scheme stipulates. I think the equity stands at (to us personally) £4000 as this is all we have paid off, roughly. We can no longer do a remortgage or try to buy the council out because i have a CCJ and the property has a charging order by Northern Rock, which Link bought. Catch 22, rock and a hard place and every other paradox you can think of
  15. Hello everyone... I have posted elsewhere on this site for help and this is another call... In a nutshell i am fighting a debt with Link Finance for £33k I also have accumulated debt with various creditors which comes to around £8k These are for: Credit cards (no longer have), bank account overdrafts, Car loan My total debt is £40k ish I have CCA all creditors and only 2 have failed to come up with anything, The debt with these two comes to around a grand. Link Finance have supplied a Credit Agreement, albeit late. Lloyds supplied one. Even though i am fighting these companies i feel it is going nowhere and at 28 am scared that i will end up taking this debt well into my thirties as i have no realistic chance of paying it off. I have a mortgage with my wife. Northern Rock had a charging order put onto our proprty before they sold the debt to Link who now have the order. I don't know what else to do, i can't sleep at night and it is causing friction between my wife and i. If i go for bankruptcy will i be forced to sell my share of the house even though the debt was nothing to do with my wife? We are also on a housing covenant scheme in which the council would be entitled to 30% of the equity (it was a low cost housing scheme) I am out of ideas but don't want my wife to end up homeless because of my doings What do i do?

  17. Update: Link have come up with the credit agreement, although the time allowed expired in December 07. What do i do now? My plan is to write back stating that they broke the law by not providing it in time. Then making an offer of payment (monthly payment £50)
  18. I think it is different as it is money borrowed from the state, not a private lender. Contact CAB and they can advise you. Social have been known to chase debts lower than 99p and can make court action move very swiftly if they want to

I was called a racist once (which i am not) by a lovely chap from a tsb call centre in India I got a statement on one of my accounts and i was attempting to make a payment but was disputing the charges applied. I couldn't really understand him as his accent was so heavy so when i explained this he went mad at me "i'm not continuing this conversation as you are being racist toward me" What's weird is his accent cleared up when he began to shout at me. I asked him when i had been racist and if this call was being recorded. He said i was being racist as i was having ago at the way he talked and that he was in India. I told him that i was then ending the conversation. Took his name (Nathan apparently) and wrote a letter to TSB head office lambasting them and there staff. I threatened court action for slander and defamation and that i was so offended being called a racist that i was going to sue them. I asked for the phone call recording but they said they only keep them for two weeks (unless it gives them the upper hand in something) They apologised and offered me £25 compo... I told them to stick it where the sun don't shine and i am pursuing this to the full extent of the law.. They have since offered me three more monetary payments (up to £100) and when i refused that offer they phoned me asking what they could do to stop this. I said i would get back to them.
  20. yes, done everything they just don't seem interested. Sent a letter back to BLS explaining the situation and that they should talk more to TSB. Makes me giggle really that these are supposed professional people

  22. Poker Mad, BLS are actually Lloyds TSB (u prob knew that) and not an outside DCA. I am having fun and games with these people. I wrote to tsb for a cca and my statements. Found out they had charged me over £600 in PPI which i NEVER signed on for. Then they say they sold it me in good faith and can see no wrong doing. Still had no CCA response 2 months later. Asked for a signed agreement for the PPI as i know i never took it coz i never do. BLS respond to inform me i have breached my repayment agreement and i have 7 days in which to...blah...blah....blah. But i can't believe they have the nerve to say I had breached!?!? They have broken the effing LAW but they will not acknowledge this or anything else i have to say. They are blinkered and can only see their objective. Relieve people of money Good luck with this

The only people in the country with that power is a judge. Link Finance will do ANYTHING to try and secure payment from you, and i mean anything. They will tell you anything that gets money from you. Like previous posters have said, CCA them and they will back down. I had a problem with LINK and i CCA them in november and have heard nothing. They havbe breached the time allowed by law and still i have heard nothing. dave
  24. How about this one I have an account with LLoyds, a classic visa which i got into trouble with. I wrote to them after calculating all my charges, it was then i noticed that i had been charged PPI over the course of me using the card. I have NEVER applied for PPI, on any form of credit i have always refused. I NEVER signed for it or anything. I told TSB this and they flat out deny it, they say they sold it me in good faith. I asked them to produce the agreement to say i had signed up for it (it's a seperate form as it is a seperate product) They won't!!! What do i do now? I have told them i want my charges back but also want the PPI payments as i never requested it. In my eyes they have broken the Law as this constitutes fraud to me
  25. A quick update... I received my first acknowledgement from one of my creditors (albeit way past the time allowed) It says the following... Dear Mr xxxx Your request for information under the Consumer Credit Act Unfortunately Cabot has not been able to provide you with the requested information within the relevant time period. We have worked hard to obtain this information for you. (oh my heart bleeds) However, the original lender has not yet been able to locate the relevant information from their archives. You are of course entitled to request the information direct from the original lender. Your Account Cabot shall continue to hold any action on your account until further notice. What happens next? Although Cabot is dependant on the original lender for the information, the relevant time period has now expired. However, Cabot shall continue to request the information from the original lender to assist you with your request. We hope to receive the relevant information shortly. Yours Sincerely E Robertson Now... What do i do? This letter is to me an almost cop out. When i have requested to speak to the original creditor i have been told that it is now the property of Cabot and they can do nothing. Yet Cabot are saying i should contact them??? Do i write back?? Help please Dave
